The Growth of California and Gold Fever

In January 1848, James Marshall was inspecting the building of a saw mill for his employer, when he saw an odd rock glinting in the upturned soil.

He was not certain whether it was gold or not and did not want to get people's hopes up. So Marshall attempted to break the yellow rock with a hammer. It did not crack, but it did dent. just like gold would. The woman who was cooking meals for the saw mill construction crew, tried another test by boiling the rock in lye.

They boiled it all day, but it did not change colour. So, they handed the rock over to the mill's owner, Mr. John Sutter, who also conducted a few tests. In the end, everyone agreed that this rock was indeed gold.

It seems that the Sierra Nevada Mountains hid huge hordes of gold, but that over tens of thousands of years, erosion had loosened up gold nuggets and the mountain streams washed them down to the bottom of the mountains. Sutter's property was situated between two rivers and so was likely to generate great wealth.

Sutter had plans to build an agricultural empire on his 39,000 acres of land, so he asked his employees to keep quiet about the strike. However, as is to be anticipated, word leaked out. In due course news of the gold find reached the small town of San Francisco.

There, a newspaper publisher shouted around the streets: "Gold from the American River!" and within three days of the news arriving, 400 of the 600 settlers had set out for Sutter's land. It was a groundswell and by the end of the year, gold prospectors had traveled to California from as far afield as Mexico and Chile.

When word of the gold strike got to the east coast, President Polk confirmed the finding. It was December 1848 and 'The Gold Rush' became a national and even a global event. The gold miners of 1849 and later years became known as forty-niners.

What has to be remembered is though, that most people, who came from Canada, Mexico and the eastern United States came by wagon train, as there were not locomotive! This meant a arduous journey of between six and nine months

Nonetheless, at least 32,000 people actually walked to California in 1849, and about 44,000 more got there in 1850. Others, such as South Americans, faced an arduous journey by sea. They suffered storms, shipwrecks, hunger and thirst, disease, and overcrowding and after all that, some still had to undergo mule rides through jungles and deserts! Still, in less than a year, about 40,000 people arrived in San Francisco from overseas.

The new arrivals caused a dramatic change in California's population, because in 1848, California had had about 100,000 residents, most of whom were Native Americans, but within two years, the state populace more than doubled but the variety of backgrounds increased tens of times.

Some prospectors found gold and made a lot of money in the Californian riverbeds, but most people did not become rich in the Gold Rush. When gold was found, the cache was usually cleared quickly. James Marshall had little success as a miner, and he died impoverished. John Sutter, who had once owned 39,000 acres, left California in serious debt after prospectors flattened his land.

In deed, it was simpler to make money selling shovels and other supplies to the miners. Most people lost everything they had, so they stayed to work the vast expanse called California or to set up businesses. By 1856, San Francisco had a very multi-ethnic population of over 50,000 people and California had become the most exciting state in the nation.

The Beach Boys Bio and Top 10 Songs

I don't think I know anybody who doesn't like at least one Beach Boys song, but I like most and have liked them since I was younger. When I was about 10 I used to save my pocket money and buy LP's and one day while I was at the market I came across Pet Sounds and bought it for 50p because I actually thought it was going to be the sounds of various animals, and thought it would be funny to own. When I got home and played it realized that it wasn't what i thought at all, but became an instant fan. After that I saved up again and again and bought more Beach Boys albums.

The guys formed in California in 1961 and initially consisted of Brian, Dennis and Carl Wilson, their cousin Mike Love and a friend Al Jardine. There were also several other members in the group at different times (David Marks, Glen Campbell and Bruce Johnston). In 1988 the Beach Boys were made part of the Rock And Roll Hall Of Fame and have had 36 US top 40 hits with 4 of them being US #1's, this is more than any other US rock band.

There were many changes to the sounds and styles of their music over the years and some account this to Brian's mental state and his use of drugs. They have released over 25 albums including some of the greatest albums to date (to my ears) including Surfin' Safari, Surfin' USA, All Summer Long, Pet Sounds, Smile, 15 Big Ones and The Beach Boys.

Some of their most famous songs are Sloop John B, Surfer Girl, I Get Around, God Only Knows, Surfin' USA, Wouldn't It Be Nice, Heroes And Villains, Good Vibrations and California Girls. Dennis Wilson unfortunately died on December 28th 1983 whilst he was diving from a friends boat attempting to recover items he had thrown overboard. His brother Carl died on February 6th 1998 after fighting for years with lung cancer.

The guys became less than friendly over the years but in 2006 the remaining Beach Boys put aside their differences and had a reunion for the 40th anniversary of the Pet Sounds album. Mike Love and Bruce Johnston still tour as The Beach Boys.

A Living Mystery - Laws of Physics Demystified in California's Mystery Spot

Next time you are in California, why not take a journey into the unknown? California is one of two areas that have the renowned Mystery Spot. Mystery Spot is one of the amazing natural optical illusions that will leave you stunned and questioning if gravity truly is a constant in our lives.

If you want more luxury on the camp site, there are some fully raised inflatable air mattresses, that look and feel like real beds. They even have bed rests and even have king size mattresses. However, these Camping mattresses take up as much space as regular mattresses and may be a little bulky. Always remember that take extra care when inflating air mattresses are they are susceptible to punctures.

A lot of Camping mattresses come with many special add-ons, like built in pillows or air pumps. Some mattresses even have built in stereo systems. Although these additional benefits add more to the price of your Camping mattress, it's okay if you're willing to pay the price for a little more luxury.

No matter what kind of Camping mattress you choose, it is important to choose one that not only fits your budget, but also fits your lifestyle. And take the size of your tent into consideration too so that your mattress wouldn't end up larger than your tent!

5 Tips for Choosing Your New Swag Bed Roll Tent for Your Next Camping and Fishing Trip

Swag bed rolls and what people want them for have really changed a lot in the past 5 years so we recently took a big trip and looked at all the best swags and asked just about everyone we met what they really, really wanted and liked in a swag.

Here are the results.

1. Make sure that the canvas used is strong, tough and at least 15oz weight. Anyone can call any fabric canvas just by dipping it in some waterproofing chemical and there are a lot of cheap swags in the marketplace which have canvas that just doesn't last.

2. Avoid swags where the foot end is sewn shut as swags can get very hot inside without ventilation and on a wet night you want to be able to get the foot of the swag up off your feet and gear because no matter what some people might tell you, canvas isn't waterproof - it gets wet and swells in the rain. This is why swags are different to nylon tents which are completely waterproof but don't breathe and so can be sweatboxes on hot nights.

3. Avoid swags that have a canvas base as water will come up through the base from wet ground. Usually you will find this type of swag has a plastic sheet built in to the bottom of the mattress. Again, canvas is not waterproof and there is nothing worse than sleeping on a wet mattress.

4. Avoid swags that have a complicated set up or can't be set up without poles. Many times on your journeys poles will be lost or broken and if the swag depends on them then it is useless.

5. Avoid swags that are big and bulky, often you will need to share luggage space with other people so you don't want to not be able to fit your swag in because it is too big.

Ask yourself is the swag you are looking at light, tough, compact, and can it be put up and down easily even if you forget or run over the poles. Imagine it is pouring rain and you are tired and want to set up quickly, or it is a cold wet morning and you want to break camp and be on your way.

These are the things you should consider BEFORE you buy, it's too late when you are out there.

Is California Going to Weaken Insurance Protections?

When Lt. Gov. John Garamendi was the state of California's chief insurance regulator he drafted a set of regulations intended to protect policyholders of disability insurance. These protections were implemented after he left office in January 2007 and was succeeded by Steve Poizner (R). Now the two are butting heads as Poizner tries to make regulation changes. According to Garamendi, these changes will weaken consumer protections and be a tragedy for policyholders.

The regulations that Garamendi created covered group disability policies and protect policyholders from experiencing a cut in benefits because of estimated pension payments, potential temporary benefits from worker's compensation, permanent disability benefits from the worker's compensation system, and estimated earnings received, unless there was a reasonable basis for the estimated calculation.

Now Poizner is attempting to roll back the regulations so that insurers can reduce group disability insurance benefits due to wages the policyholder may receive, workers' compensation, and pensions. Poizner says the regulations are not necessary because state and federal laws already ban insurers from reducing benefits in disability clauses due to offset clauses.

While this may make sense, Garamendi has expressed that they will not be able to protect policyholders without the regulations, and stands firm that he drafted the regulations due to severe problems within the system, including scandals, denial of claims, using offsets, and denial of coverage. Garamendi has also expressed worry that this only benefits the insurance companies so they can continue controlling the benefits. Incidentally, the American Council of Life Insurers and the Association of California Life and Health Insurance Companies support getting rid of the regulations. These associations write most disability insurance policies in the United States.

There is currently an ongoing debate over the disability regulations. Hearings have been held by the Department of Insurance and they are still considering amendments to the regulations, which would have to find approval from the Office of Administrative Law.

There are currently more than 4.5 million Californians with disability insurance purchased either through an individual plan or a group policy. Most employers offer this insurance, which usually replaces at least half of a worker's income, should they become injured, ill, or disabled.

Top Must-See Attractions in Orlando, Florida

Since the weather in Florida is mostly sunny year-round, it is always a fine day to go exploring in the most welcoming town in the nation's sunniest state (sorry, California, you come in second). Of course, the 800-pound gorilla is Disney World, where you could spend an entire two-week vacation and still not see everything.

Yet there is so much more. Why not do a little wine tasting at the Orlando Food and Wine Fest that is held every November? There are other attractions for kids of all ages, including several world-class golf courses for the golfer in the family. There are plenty of water activities, this being Florida, after all, but a great selection of things to do on dry land, too.

Disney World, a triple threat
Four Disney theme parks are spread over an area about the size of Boston. The Magic Kingdom is the best place for families with little kids, while people who try to see all of the Experimental Prototype City of Tomorrow (EPCOT) will say that the acronym stands for Every Person Comes Out Tired. There is a lot to do there! Rounding out the quartet of parks are Disney's Hollywood Studios and the Animal Kingdom.

There are two water parks, over a dozen other themed mini-resorts that are fun in themselves and much more. Make sure you have a good plan figured out beforehand, because entering "the World" without a map, game plan or time limit is a sure route to exhaustion. If you wanted to, you could stay in Disney World for your entire vacation. Still, there is more than Disney in Orlando.

Other biggies in town
Orlando's other prime time multi-park resort is Universal Orlando. There are two different theme parks. The Islands of Adventure park has a special "zone" for toddlers and "little kids," while the 10-acre Seuss Landing is based on the popular Dr. Seuss books and features "The Cat in the Hat" ride, the "One Fish Two Fish Red Fish Blue Fish" ride and more. During the holidays there's a special "Grinchmas" celebration, too.

You will also find a fabulous shopping and entertainment zone at Universal Florida, called CityWalk, which adjoins the two theme parks. The CityWalk area offers shopping, entertainment, the Blue Man Group shows and other entertainments. Despite much of CityWalk being geared to partiers, kids will also get a kick out of the theme restaurants like NASCAR Cafe with its auto-related game area, Hard Rock Cafe with giant desserts and rare rock-'n'-roll collectibles, and NBA City with both videogames and giant-screen basketball games.

Lots of great choices
There are all kinds of other attractions in this exciting Florida city. If you've never been to Miami, you can take the One Day Miami Tour from Orlando and discover the most "upbeat" city on the East Coast. If you only want to invest half a day, then try Gatorland, voted Orlando's "best half-day attraction" in the local papers. The self-described "Alligator Capital of the World" is a huge, 110-acre alligator theme park as well as a working wildlife preserve.

You can also explore the amazing, one of a kind Florida Everglades with a Boggy Creek Airboat Ride. A half-hour airboat ride is both educational and exciting, for all ages. If it's youngsters you're thinking about, though, try the Fun Spot Action Park with its unique elevated go-kart racetrack, family and thrill rides, special "toddler" activities and more. The kids will also enjoy the famous Green Meadows Petting Farm, an animal education disguised as fun, where kids and their parents can all spend some quality time with a variety of farm animals. The Farm also features hay rides, pony rides, small-scale train ride and more.

Additional attractions
Of course, there are activities for the head in Orlando, too. In addition to various museums and parks, there is the Haunted Grimm House (slogan: "It's a scream!") that offers special effects, dark and scary rooms and passages, as well as sudden, unscripted encounters with live actors in various guises. Ripley's Believe It or Not! Orlando Odditorium is a strange, funny-but-interesting museum that offers interesting, odd and interactive exhibits based on both science and legend.

WonderWorks is a different kind of amusement park. It is definitely one for the mind, and it dares you to stretch your imagination as you explore the various interactive exhibits. It is here that you can experience Orlando's only "upside-down" entertainment attraction. Finally, Train Land International is just what "the conductor" ordered for all of you model train collectors and enthusiasts. Railroad fans both young and old can learn the history of trains, both full- and small-scale, and examine a fabulous collection of miniature models, many still in action after a century or more.

To sum up, there is so much to do in Orlando that you need to plan your visit very carefully. Unless you want to stay put in Disney World, you will need to do a little planning, map-making and scheduling, because there is so much to do you can't expect to show up and make sense of the myriad choices. Get out a map, hit the Internet, poll the family members and then make plans to visit Orlando, where you can do anything and everything under the sun - and under the moon, too!

Chaque chef a sa recette où il peut éliminer ou ajouter quelques ingrédients. Le Nori Le nori est une algue originalement cultivée dans le port de Edo (ancienne toyo). Il était arrache des pilons, pressé en forme rectangulaire et séchée au soleil. Actuellement la version commerciale est cultivé produit, toasté, emballé et vendu en feuilles standards de 18 par 21 cm. L'Omelette Certains sushis remplacent le nori par une omelette très fine. Cette omelette est traditionnellement faite dans une poêle japonaise appelé makiyakinabe. Strawberry and Chocolate Facts

Where did the name come from for the strawberry? Now the name itself is a bit of a mystery. Researchers have often guessed that because the offspring from the main strawberry plant scattered around it, they had "strewn" runners. Hay was also harvested simultaneously with the blossoming of the ripe strawberries, and thus these berries that were ready when the haystraw was were coined as strawberries. The old English world for hay was streaw. Yet another interpretation of the story is that in order to stop the berries from rotting, farmers actually placed straw around the plants on the ground.

For a great number of kids, strawberry is the top choice. In fact, the USDA states that over half of kids in the United States say strawberries are their number one fruit pick. And believe it or not, the strawberry is related to the rose. They are members of the same family. This is yet another reason we see the connection between the act of giving delicacies like chocolate covered strawberries and roses as romantic gifts.

A lot of people love to indulge in strawberries during the spring and summer months It's often an reflection and remembrance of simpler and more carefree days past by. Chances are if you've eaten a lot of them on the farm, on the porch, dipped as chocolate covered treats, or cut up in a fresh fruit salad, that they came from California. Nearly 75% of all the strawberries in the US are grown in the Golden State. The next largest state producer is the sunshine state of Florida. But strawberry growing is primarily a West Coast-dominated endeavor.

So where did this marriage of chocolate and strawberry come from? There's a lot of berry fruits which don't have that enveloping allure and melding with the cacao bean richness. Some of it is simply the structure of the fruit. A strawberry has a large surface area. It's dense and the seeds help keep the chocolate a bit more focused on the berry.

A melon piece, for example, is certainly succulent and delicious. But it doesn't have the surface that allows chocolate to stay put as well. It's also much more watery. It works, but it's not a perfect match. Really, the chocolate covered strawberry is still the king. The combination of red and black is also deeply sensuous. It's something that psychologically lines up with romance, passion, emotion, and intensity. This combo won't be knocked off the top ranks anytime soon as a perfect pairing for romantic evenings.

The Isley Brothers - Success at Its Best

The original members of the Isley Brothers were O'Kelly Isley, Jr., Rudolph Isley and Ronald Isley. They were the elder sons of O'Kelly, Sr. and Sally Bell Isley, and were raised in Cincinnati, Ohio. The group was originally formed in 1957 as an African-American R & B band but also branched into soul music and funk. As a group, they had several lineups aside from the original trio - a quartet, a sextet and a duo over the years of their career.

The Isleys started their recording career with small labels, doing doo-wop and rock n' roll music, but in 1969 their brand of gritty sound and funk single titled "It's Your Thing" earned them their first Grammy Award. Before this, they had their taste of modest success with their singles such as "Shout", "Twist and Shout", and "This Old Heart of Mine (Is Weak for You)". They also had a short time collaborating with Jimi Hendrix as background guitar player.

Going back to the beginning, the Isley Brothers' were first exposed to the public at church performances. Kelly, Rudy, and Ron were taught by their parents to perform in front of audiences, and they later convinced the trio to form a new singing group in 1957. The group left Ohio for New York and started recording doo-wop music.

RCA Records noticed their performance at a Jackie Wilson concert, where they sang an opening number for the main act. RCA were impressed and signed them up. They started recording for RCA and "Shout" was the group's first single to hit the charts, reaching no.47 on the Billboard Hot 100. The group was released from their contract when it was not able to chart another hit after "Shout".

Their first top 40 single was "Twist and Shout", originally recorded by the Top Notes and later covered by The Beatles. This was recorded just after they signed with Wand Records in 1962. The group released other follow-ups but finally left Wand Records in 1964, moving to New Jersey and forming T-Neck Records. The anticipated level of success did not come with T-Neck so they signed with Motown under Tamla in 1965.

Their biggest Motown success came with "This Old Heart of Mine (Is Weak for You)", which Ron was later to record with Rod Stewart. It reached number 12 in the Hot 100 and no. 6 at R&B. However, history was repeated when they were unable to produce a successful follow-up, so in 1968 requested that Motown release them from their contract.

After discovering that they had a good fan-base in Britain, the Isley Brothers tried to break into Europe. They did tours in the UK, pushing their three Motown singles "This Old Heart", "Put Yourself in My Place", and "Behind a Painted Smile", the latter reaching the top 40. They returned to the United States with a new image and moved and signed in with Buddha Records.

They also revived the T-Neck label, and with Ernie on lead guitar the group recorded the gritty soul single "It's Your Thing". It became the group's biggest charting success, rising to no. 2 on the Billboard hot 100 and winning a Grammy Award for Best R&B Vocal Performances by a Duo or Group.

Motown CEO Berry Gordy claimed that "It's Your thing" was recorded while they were still with his record label, and after several years of wrangling they reached an out-of-court settlement. The group's tenure with Buddha Records produced several albums, including "The Brothers: Isley", "Givin' It Back" and "Brother, Brother, Brother". Chris Davis, then CBS Records president offered the Isley Brothers a long term deal with Epic so they left Buddha in 1973.

In 1973, they reformed with six members, including younger brothers Ernie Isley and Marvin Isley and brother-in-law Chris Jasper. They called the band "3+3" for obvious reasons. The albums that earned them gold and platinum were titled "3+3", "The Heat Is On", "Go For Your Guns" and "Between The Sheets". Their hit singles include "That Lady", "Fight The Power", "For The Love Of You", "Don't Say Goodnight (It's Time For Love)" and "Between The Sheets", recorded from 1973 to 1983.

Their days as 3+3 were considered by many as the most successful of the different group reformations. Chris Jasper, Ernie and Marvin left in 1983 and formed the Isley-Jasper-Isley group, leaving Kelly, Rudy and Ron as the original line-up. They left Epic as a trio and joined Warner Bros. Records.

The three of them released "Masterpiece" in 1985, but Kelly died of a heart attack the following year, leaving Rudy and Ron. In 1987, they collaborated with producer Angela Winbush and dedicated their album "Smooth Sailin" which included the song "Sending a Message", as a tribute to Kelly's memory. Rudy left the group to become a minister, while Ron married Winbush. Carrying on a solo career, Ron worked with Rod Stewart on the remake of "This Old Heart of Mine".

In 1991, Ron reformed a trio with younger brothers Ernie and Marvin. They recorded the album "Tracks of Life" in 1992 and in that same year, the Isley Brothers, as a group, was inducted to the Rock and Roll Hall of Fame. The group's popularity was significantly boosted by Ron Isley's music video character as lead singer in the hit album "Mission to Peace" in 1996. They reached the top of the charts with "Contagious", with its heavily rotated video. They held the record of being the only group to have a single and album in the charts over five decades, longer than any other group in the history of the charts, and all because of "Contagious" and "Eternal".

Marvin's battle with diabetes was a big blow to the group's career when he retired in 1997, and he had both legs amputated because of it. Rudy still lives with his wife Elaine in California, and little is heard about Chris Jasper and Ernie Isley. In 2006, Ron Isley was convicted of tax evasion and was imprisoned for taxes unpaid for the five years from 1997 to 2002, and during that period he was also diagnosed with kidney cancer. In 2003, The Isley Brothers were inducted to the Vocal Group Hall Of fame.

The Isley Brothers were a fabulous band and had many fans. They probably reformed in different guises more times than any other band, but their fans remained with them and they remain an iconic group. Age caught up with them, but it cannot be disputed that they rank up there with the other Tamla greats of the era, and are one of these bands that will never be forgotten.

Studies Find Multiple Strategies Needed to Improve California Schools

For the past three years California Schools have been the subject of an in-depth analysis of school reform. The study, Beyond the Mountains: An Early Look at Restructuring Results in California, conducted by the Center on Education Policy (CEP), is part of a multi-year review of the effects of the No Child Left Behind Act (NCLB) on Maryland, Michigan and California Schools.

The examination concerns specific restructuring methods used by California Schools and their success. According to CEP founder and president Jack Jennings, "While it is still too early to tell whether restructuring is working, it is clear from the experience of California and Michigan, the two states we have studied in-depth, that simply requiring schools to replace staff does not guarantee increased student achievement. Rather, success is linked to implementing multiple improvement strategies."

This is of critical concern to California Schools for a couple of reasons. California Schools have more schools facing restructuring than most other states for several reasons. School restructuring is mandated by the NCLB act for any schools unable to meet its Adequate Yearly Progress (AYP) markers for five or more consecutive years. One reason that California Schools saw the number of its schools facing this mandate double to 8% in the last year is because of its massive size. Also, California Schools implemented AYP markers a year before it was federally mandated. Of the California Schools facing restructuring, over 60% are in urban areas.

The numbers don't look good. 207 of the California Schools in the implementation phase of restructuring failed to meet AYP standards for seven consecutive years. That's why the CEP study has such import. The study concluded that the California Schools that were most successful in raising student achievement were those that analyzed school data and implemented initiatives designed to meet those specific needs. This is important because the US Department of Education previously recommended replacing staff rather than other forms of restructuring.

Other reform methods in California Schools include instituting English Language Learner programs, direct coaching for teachers and principals, changes in scheduling and the hiring of a district-level coordinator. The California Schools that used the above methods, without replacing staff or changing to a charter system, were generally more successful than the other schools studied. What will this mean for the future of California Schools?

It's likely that funds for teacher planning time, instructional coaches and special instruction for at-risk students will appear on coming legislation. As noted by Jennings, the California Schools still have a long road ahead before the success of many programs can be fully evaluated. That's why California Schools need the quantifiable results of a study like this one.

5 Terrible Rock Breakups

Although rock music has stayed for years and years, many bands have broken up. To the disappointment of their fans, these famous bands did not stay to keep rock and roll alive. It's a good thing their songs do live on.

The Beatles

When Japanese artist Yoko Ono came into John Lennon's life, every other Beatle resented her. John also got tired of Paul Cartney, and George Harrison felt left out. Most fans accuse Ono of breaking up the Beatles, but others say there was also the issue of the Fab Four wanting to move forward to individual musical careers, and of course, the death of their manager, Brian Epstein. Their final year together was in 1969. And everyone did move on with their own musical careers.

The Doors

After the death of Jim Morrison (lead vocals) in 1971, the Doors disbanded a year later. In 2002, Doors of the 21st Century was formed, led by the Doors' keyboard player Ray Manzarek and guitarist Robby Krieger. In 2002, John Densmore, drummer of the the Doors sued the band for use of the Doors' name.

Sex Pistols

Sid Vicious, bass guitar player of the band, was addicted to heroin, resulting to violent and unpredictable behavior. Johnny Rotten, lead vocalist, could not stomach Vicious' wasteful behavior. To add to this, the singer constantly had angry rows with their manager, Malcolm McLaren. In 1978, while on tour in California, Rotten declared that he was going to leave the Sex Pistols. The rest of the band left Rotten "rotten" in Los Angeles. He had no money and no plane ticket to go back home to England.

Blondie

In rock and roll fashion, Blondie frontwoman Debbie Harry took most of the spotlight, of course, being the frontwoman of the band. The other band members must have felt the tension growing, because this led to their dissolution. At their induction in the Rock Hall of Fame, Debbie Harry gave her ex-bandmates Nigel Harrison and Frank Infante the cold-shoulder, refusing to come up the stage to join the rest of Blondie.

Pink Floyd
Syd Barrett (Pink Floyd's original vocalist) left the band in 1968 due to a mental illness caused by drug addiction. Roger Waters (bass player and vocalist) also leaves in 1985, just after releasing 'The Final Cut'. Many consider the album a solo gig, with the other members pushed to the sidelines. Eventually, after leaving, he sues the rest of the band for use of Pink Floyd name.

California Home Loans With New FHA Guidelines

For those in California home loans with the FHA are coming under new guidelines beginning January 1, 2010. People in California need to be aware of the changes so that they can make the best decision for their own finances. Congress recently passed a bill that will extend the current FHA loan limits for 2010. Presently California FHA loan limits are capped at $625,500 in specified high cost regions.

What are the changes and what do they mean? Current California home loans with the FHA are relatively easy to get. They require no appraisal at this time. There is no maximum loan to value ratio and there is no asset verification. Income verification is not required and lower credit scores can qualify. And right now, because of the lack of these traditional restrictions, there are quick turn-rounds available on these loans. This has made California FHA loan refinances extremely popular with many people looking to lock in a lower rate. But time has become of the essence. This is going to change at the beginning of 2010.

On January 1, 2010, California mortgage loans with the FHA will become more difficult to get. If the home owner wants to roll his closing costs into the mortgage, an appraisal is going to be required, and it is now recommended in all cases. Without an appraisal, the new loan amount cannot exceed the principal due plus the new up-front mortgage insurance premium. The maximum loan to value ratio is going to be no more than 97.75%. If a homeowner wants to lower their rate by purchasing discount points, those cannot be rolled into the mortgage. Assets and income are going to have to be verified before approval. The homeowner also must be employed at the time of application. And there will be tighter credit restrictions as well. With these added restrictions, quick turn-rounds will be a thing of the past. All of these changes will likely not lower the FHA refinance's popularity. But it will make it available to fewer people.

Given these changes, FHA borrowers with California mortgage rates that are adjustable need to make decisions on FHA refinancing. If the tighter restrictions will make their hopes of refinancing fade, they might want to get the process done prior to the end of 2009. That means getting their loan documentation submitted and approved quickly. However, if they can live with the tighter restrictions, it might pay to wait until the beginning of 2010. It depends on the individual homeowner and their situation. Speaking with a California mortgage professional will help you make the refinance decision that is best for you.

The History of The Eagles and Hotel California

Hotel California was the fifth album released from The Eagles. American rock was starting to establish itself as a leading, powerful genre in the music industry. Younger crowds were beginning to catch on to the phenomenon and American Rock was becoming a part of culture. Music had a way of gripping society just as it does today. In more recent years you'll find that "rap" and "hip-hop" has direct ties to American culture amongst younger generations. Hotel California was also the first album released by the Eagles that was not accompanied by the founding member of the band, Bernie Leadon.

Bernie had other responsibilities in his life that led him away from the band for that time period. Joe Walsh was featured in Hotel California and this was his first year with the band, essentially replacing the empty slot that Bernie Leadon had left open. Hotel California was unfortunately the last album that featured Randy Meisner, a promising bass player and singer who did great things for the band. The memories that Randy Meisner provided will be remembered forever.

Despite all of these challenges that Hotel California brought to the table, it managed to become the critical success of the band. It was a huge commercial hit and it brought the Eagle renowned success across the country and across the world. You can be sure that Bernie was regretting his decision to part form the band. How unfortunate his decision to leave was for himself, it may have been part of the reason the album was so successful. The remaining members along with the accompaniment of their newest member, Joe Walsh were album to craft their talents into amazing songs that transpired into building a huge fan base for the band.

The album was released in 1976 and has sold over 16 million copies since. This is only accounting for the U.S, global sales charts estimate several more millions in sales. The album managed to maintain a number one spot on the charts for eight weeks in 1977. Two songs from the album became number one hits as singles on the Billboard Hot 100. To be featured on the Billboard Hot 100 was a promising achievement. Later, TV Network VH1 deemed Hotel California number 38 on 100 Greatest Albums of all time. Hotel California was also ranked 13th on a 2005 survey for British Television. Rolling Stone Magazine determined it's rank as 37 on their list of 500 greatest albums of all time.

The album has since been released digitally and has been upgraded for premium performance in sound quality. The album has been very highly regarded for several decades and it will long be remembered as a promising aspect of American history. The Eagles gave Americans something to idolize in society

California Conservatorships

Background

Definition. A conservatorship is used in California where a person cannot handle their own financial matters or take care of themselves physically, so another person is appointed by the Court to handle these matters.

Since 1981, in California a guardianship can only be obtained for someone under the age of 18. Other states, though, use the term "guardianship" for what California now calls a conservatorship.

Terminology. A conservatorship must be established by a court. The person needing the help is called the "conservatee" and the person who receives authority to handle financial, medical and/or other matters for the person needing the help is the "conservator".

Types of Conservatorships. There are two basic types of conservatorships, a conservatorship of the person and a conservatorship of the estate. Often one conservator fills both roles, but it does not have to be that way.

Conservator of the Person. A conservator of the person makes sure that the conservatee has appropriate food, clothing, shelter, healthcare, social contact and sources of enjoyment.

Conservator of the Estate. A conservator of the estate handles the conservatee's finances.

A conservator of the estate must use the conservatee's money and other assets to support (and educate, if appropriate) the conservatee and any dependents the conservatee has.

If the appropriate court order is obtained, the conservator can handle not only the conservatee's personal finances but his/her business matters as well.

The Process

Starting the Process. A conservatorship is started by filing papers with the Probate Court and giving copies to the proposed conservatee and his/her close relatives.

Obviously, this can be a painful process for the conservatee, who is being required to give up rights to manage his/her finances, make his/her own medical decisions, etc. Still, sometimes a conservatorship is unavoidable.

Court Investigator. A court investigator must talk with the proposed conservatee and others who may know something about the situation.

The Hearing. A hearing date is scheduled and at the hearing the judge decides whether a conservator will be appointed and, if so, who that will be.

Unless the proposed conservatee is unable to attend for medical reasons, the proposed conservatee should be present at the hearing, as the Judge will often want to question them.

Note that it is possible for someone else, usually a family member, to object to the proceeding or propose a different conservator.

Inventory and Appraisal. Within 90 days of the date the Judge signs the Order Appointing Probate Conservator, the conservator must file a report with the Court listing the assets that the conservatee owns.

More specifically, the conservator prepares an Inventory and Appraisal form. If there are assets other than cash, the conservator must forward the Inventory and Appraisal to the probate referee, who is appointed by the Court. The probate referee will appraise the non-cash items, complete the Inventory and Appraisal by inserting the value of those items, and return it to the conservator, who must file it with the Court. The probate referee usually takes four to six weeks to return the form.

The estate is charged a fee for the appraisal, generally 1/10th of 1% of the total value of the conservatee's estate, with a maximum fee of $10,000. The probate referee may also be able to recover expenses, such as mileage, in addition.

Court Investigations. Once a conservatorship is in place, the Court conducts periodic investigations to confirm that the conservatorship is still needed and that the conservatee is being treated appropriately.

Bond and Periodic Accounting. If the conservator is handling the conservatee's finances (which is generally the case), the conservator must post a bond and must provide detailed accounts periodically to the Court that list all income and expenditures.

Amount of Bond. The amount of the bond depends on the assets that the conservatee has and his/her annual income, as well as whether a professional bonding company (versus family members or friends) is providing the bond.

Bonding Companies. Note that most bonding companies will not issue a bond unless an attorney is handling the conservatorship proceedings

Status Reports About the Conservatee. Often the conservator must also prepare periodic status reports stating how the conservatee is faring and what the conservator is doing in regard to his/her duties.

Cost. Usually the cost of the conservatorship comes out of the conservatee's income or other assets.

Fees and Reimbursements for the Conservator.

Expenses. Generally, the conservator is entitled to reimbursement for reasonable expenses incurred on behalf of the conservatee, including expenses to establish the conservatorship and sometimes money spent supporting the conservatee prior to the conservatorship.

With the exception of Court filing fees and premiums on the bond, the conservator must obtain Court approval before receiving reimbursements from the conservatee's estate.

It is crucial for the conservator to keep receipts and records of all expenses (and reimbursements).

The conservator is allowed to hire help as needed - for example, an accountant - as long as the expense is reasonable in comparison with the size of the conservatee's estate.

Generally the conservator cannot be reimbursed for postage, photocopies, mileage or the cost of trips to court.

Compensation for Time.

It is crucial that a conservator who wishes to receive compensation for his/her time keep a detailed written record of the time spent on the conservatorship, indicating the date, amount of time and the work done on an entry-by-entry basis.

Courts usually allow a family member to recovery only for time spent on managing the finances of the estate, and not for any time spent acting as a family member (such as visiting the conservatee) or for acting as a conservator of the person.

Courts may not allow compensation for time if little time has been spent on financial matters or if the conservator has not followed court procedures, including filing accountings on time.

Some courts have schedules that set out the compensation that a conservator may receive for his/her time, often a percentage of the conservatee's estate.

The conservator may only petition the Court for compensation for time after the later of both:

90 days after the Letters of Conservatorship were issued; and when the Inventory and Appraisal is filed.

Alternatives

Powers of Attorney. Unfortunately, the process of obtaining and maintaining a conservatorship is expensive, which is why we strongly urge people to sign powers of attorney that designate who will handle their affairs if they become incapacitated. If the proposed conservatee is mentally competent, by far the best approach is to have him/her sign durable powers of attorney. There are two types of powers of attorney.

Durable Power of Attorney for Finances. One type of power of attorney is a durable power of attorney for finances, which designates which people can handle the grantor's financial affairs (such as paying bills) if the grantor becomes incapacitated.

Advance Health Care Directive. The other type is durable power of attorney for health care. In California this is now known as an advance healthcare directive. This is designed to allow the grantor's designated agents to make health-care decisions if the grantor is incapacitated.

Agents. Frequently the spouse (or partner) is the primary agent, and then adult children or friends are the successor agents in case the primary (or subsequent) agent is unable (due to incapacity, etc.) or unwilling to act.

Medical Decisions. Often if a person is incapacitated, medical personnel will allow the family members to make medical decisions if they are all in agreement. It is also possible to obtain court authorization for specific medical procedures, but if authority is needed on an ongoing basis a conservatorship may be more effective.

Representative Payees. Most government agencies allow another person (a "representative payee") to receive checks for the beneficiary and spend that money on the beneficiary's behalf. Each agency has its own application procedures and requirements. Many agencies require the representative payee to provide them with periodic accountings.

Community Property. If one spouse becomes incapacitated, the other spouse usually can manage all of the community property that they have.

This will not help if action needs to be taken regarding any separate property the incapacitated spouse has.

Also, even with community property, the spouse with capacity may not be able to roll over Treasury bills, sell stock, or sell or obtain loans against real property.

Again, it is possible to have the court authorize the spouse to make specific transactions, but it may be easier to obtain a conservatorship if ongoing authority is needed.

The Leading Los Angeles Tourist Attractions

Los Angeles is one of the leading travel destinations in the world and is the premier destination in California for tourists and travelers. The city and the surrounding area are home to famous attractions such as Hollywood, Malibu beach and Disney World.

Echo Park

If you are looking for a nice place for a picnic or to spend some quiet time then please do visit Echo Park. It is 26 acres in size and there is a splendid lake where you can hire peddle boats. Echo Park is located along Bellview Avenue and is open Monday through Sunday from 07:00 until 22:00.

LA Zoo and Botanical Gardens

This wonderful attraction which has recently had its 50 years anniversary is located at Griffith Park and is 113 acres in size. Close to one and a half million visitors visit the Los Angeles Zoo and Botanical Gardens every year. There are also a number of different shows and special events organized at the Zoo and Botanical Gardens. Opening hours are daily from 10:00 until 17:00.

Hollywood RockWalk

If you are a big rock and roll fan then you simply must plan a trip down to the Hollywood RockWalk.  You will find small blocks of cement which contain the signatures and handprints of some of the most famous rock and roll artists of all times and which include those of B.B.King, Chuck Berry and Johnny Cash.

J. Paul Getty Museum

One of the most impressive museums in the United States is the J. Paul Getty Museum. Visitors can view a large collection of artwork and includes pieces by famous artists such as Rembrandt and Vincent van Gogh. The great thing about visiting this popular tourist attraction is the fact that admission is free. There is also an excellent and very popular restaurant located at this museum. Opening hours are Tuesday through Thursday from 10:00 until 18:00, on Friday through Saturday from 10:00 until 19:00 and on Sunday from 10:00 until 18:00.

Paramount Studios

Los Angeles is off course well known for its film and television industry and there are a number of word famous studios located in this Californian city. So if you are in town then why not visit the Paramount Studios which is located in Hollywood along the famous Melrose Avenue. If you are lucky then you can even attend a screening session.

Prolonged Sitting at Work - Exercises to Help You Loosen Up

Sit much?

Millions of people work 8 hours or more every day glued to their seats! For most office workers, this is normal routine, but we all know that sitting in front of your computer daily for hours can wreak havoc on our bodies.

Long hours of sitting can cause:

* Shoulder aches

* Eye strain

* Neck pain

* Carpal Tunnel Syndrome

* Lower back pains

I used to live the corporate life, and all the sitting took a toll on my lower back. Prolonged sitting, no matter how much I tried to maintain good posture, is a killer. Because of the kind of job I had, I developed lower back pains. The nasty back pains led me to several doctor visits and yoga. Today, I'm happy to say that I don't suffer from back pains anymore.

If you are one of those women who have to be at a desk all day, make sure you follow these simple steps:

* Sit properly - back straight, shoulders back and your monitor should be level with your eyes.

* Keep legs bent at the knees so they are slightly higher than your hips.

* Keep your feet flat on the floor or on a stool.

It's also very important to do some stretching exercises within your workday. This will help alleviate the feeling of stiffness after long hours of sitting. Do these simple exercises to help you loosen up and reenergize your weary-from-sitting body:

Neck and shoulders:

To lessen tension and strain, bend your head forward/backward, side to side then look right and left. Then roll your shoulders forward for around 8-10 times, then backward. This also helps release the tension.

Wrists and ankles:

Roll your wrists around at least 10 times clockwise, then reverse. This will help prevent Carpal Tunnel Syndrome if you type a lot!

Do the same thing with your ankles. Rolling them around will help improve blood circulation.

Calves:

Lift up your legs on the balls of your feet while sitting and set them down. Repeat until your legs are comfortably tired. Repeat after about 10-15 minutes later. Do this several times within the day - this will exercise your calves, and will help prevent blood clots from developing in your legs.

Aside from these simple stretches, you can also check out some yoga exercises for your back, neck and shoulders. I've tried some of them, and believe me, they feel great!

Finally, take a walk. Inside your building.

One of the things I did when I was slaving away in the corporate world was to take regular walks to ensure continuous blood circulation in my body and keep them from getting too strained. I would take walks to the water station to refill my glass or get coffee. Whenever I had longer breaks, I would take a short walk around or outside our building, and even go up and down the stairs! I looked crazy, but I know I needed it. Aside from giving your legs and heart a good workout, a good walk will allow you to take in fresh air as well.

WORST SUSHI EVER!! (6/2/2010 - Vlog 1)

Clicky here for more info... Well, I decided to start a vlog. It may not be the greatest, and it's impossible to compare it to the likes of ShayTards and CTFxC vlogs, but I'll get the hang of it sometime. It's not going to be daily, most likely when I have something interesting to share... so enjoy! WORST SUSHI EVER!! (6/2/2010 - Vlog 1) So my friends and I decided to eat at a sushi place. We had enough space in out stomach's but after round 2, it went downhill. We ordered stuff we didn't know, we, how do you say it, experimented! But there was one particular maki sushi that didn't taste all the great. My 2 friends (Daniel and Deo) decided to take on the dare of eating spare rib maki (if you think about it, it doesn't sound that bad, but the tastes was not the greatest...)
