Arizona is quite possible the best place in the United States to go golfing. The best way to navigate these beautiful golf courses is to use a golf cart. In a state known for it's heat it quite a comfort to have a golf cart close by for many reasons.

The Purchase and Sale of Commercial Real Estate in California

I - Risks are allocated in commercial real estate transactions by the negotiation of representations, warranties, disclaimers, and releases.

A warranty or representation is an affirmation by the seller of a fact or facts relating to the property. See, 3 Witkin, Summary of California Law, Sales §§50-75 (9th ed 1987). Failure of a condition in the agreement generally excuses a party's performance, but breach of a warranty entitles a party to damages and possibly rescission. Unless a warranty is also a condition, its breach will not relieve the buyer from the duty to perform, although any damages might be offset against any sums owed by the buyer. See 1 Witkin, Summary, Contracts §§721-723.

While warranties allocate the risk of certain potential post closing events and can force sellers to make disclosures, the limits placed on the Seller's warranties can also serve as a road map for the Buyer's due diligence.

Beginning with the letter of intent, the Seller's objective is to give as few warranties as possible, to limit the scope of the warranties given, and to provide that if the Buyer approves the property, the Buyer will be relying solely on its own investigation and purchasing the property "as is."

Warranties are often heavily negotiated because of the parties' competing objectives: The buyer wants protection from unknown risks, while the seller wants to eliminate warranties or at least limit them to necessary disclosures. If the purchase price has been discounted, or if the seller is in a liquidation mode, or if the buyer has negotiated a substantial time period during which to conduct a due diligence investigation, the seller may be unwilling to give more than minimal warranties.

II - Sellers should be made aware that they cannot fail to disclose material information about the property in their possession without risk of liability, even if the seller has made no warranties.

In the final analysis, the Seller's best protection is to make full and fair disclosure in writing about the property. This can be done by qualifying any representations and warranties by the disclosure of problems with the property set forth in one or more exhibits to the purchase agreement.

An "as is" clause will not protect the Seller from the failure to disclose materia! facts known to the Seller which would affect the Buyer's decision to purchase least when those facts are not readily discoverable by the Buyer. See Loughrin v. Superior Court (1993) 15 Cal. App. 4th 1188; Shapiro v. Hu (1986) 188 C.A. 3d 324.

An "as is" clause will relieve the Seller from liability for defects in the property where the Seller was not aware of the defects even if they were not readily discoverable by the Buyer. Id.

A release with a waiver of Civil Code § 1542 initialed by the Buyer will bolster an "as is" provision, particularly where the purchase agreement delineates the types of risks being released.

In addition, a covenant not to sue is helpful to underscore the understanding of the parties, e.g. in the absence of a breach of warranty that the Seller will not sue the Buyer relating to the condition of the property after the close of escrow. Once again, a fraud claim will not be defeated by such a provision.

III - The extent to which representations and warranties can be obtained from a seller depends upon both the nature of the warranty requested and the relative bargaining strength of the parties.

Some types of properties are traditionally sold without any warranties, such as "real estate owned" or "REOs" which have been foreclosed upon by an institutional lender.

Even where an REO is not involved, institutional sellers will seek to limit certain types of warranties to the actual knowledge of those employees who have had "hands on" involvement with the property.

The Seller's goal is to limit future liabilities as much as possible.

A. This particular concern can sometimes be resolved with a very short expiration period for the warranties. This "survival period" is negotiable, but will probably be shorter than the applicable statute of limitations.

B. The Seller will want to avoid any "hold backs" in escrow of a portion of the purchase price during the survival period. Depending on the nature of the potential problem and the future of the Seller, the Buyer may seek to negotiate a hold back.

C. It is also helpful for a Seller to negotiate a "floor" (a claim will not be allowed unless the alleged damages exceed a minimum amount) and "ceiling" or upper limit on warranty liability (except where a claim is based on intentional fraud).

The buyer will also want the purchase agreement to specify which representations and warranties survive the closing.

Warranties that the Seller is duly organized, has authority to execute the documents and has obtained all necessary consents to the sale will customarily be given by a Seller.

Warranties with respect to title matters are not customary in California and sellers will take the position that title insurance and endorsements will adequately protect the seller. Also, a seller may provide the buyer with an ALTA survey. The buyer can then specify which title exceptions and survey matters should be eliminated or cured before the closing.

An exception may occur with respect to unrecorded matters and leases. A seller should be willing to warrant that no unrecorded matters affect title, except as disclosed in an exhibit to the purchase agreement or by the ALTA survey discussed above.

A Seller should be willing to warrant that an attached rent roll identifies all leases affecting the property.

Warranties with respect to absence of claims, litigation, condemnation and similar matters are often given by Sellers if qualified by the "actual knowledge" of specific persons who are knowledgeable regarding the property. The Seller will also want to provide that the employee with actual knowledge will not be personally liable for breach of a warranty.

The use of "to the best of Seller's knowledge" may create problems since it may imply some level of diligence which is not adequately defined. The Buyer will argue that such a warranty includes what the Seller actually knows, plus what he or she should have known after a reasonable investigation.

An absolute warranty has no limitation and will be very difficult to obtain from a sophisticated Seller, except for matters such as those set forth in paragraph E. above.

Warranties with respect to the accuracy of financial information regarding the Property can be a major source of negotiation.

If the information is incorrect, the parties should negotiate who will bear the loss. This is a different issue than determining whether the Seller has "knowledge" and whether the knowledge is "actual" or "best" with an implied obligation to investigate.

If a warranty is given it should cover the accuracy of all expenses included in pass throughs to the tenants of the property.

Warranties regarding lists of tenants, rent rolls, lists of service contracts and true copies of documents are customarily provided by the Seller. However, Tenant estoppel certificates are the customary method for Buyers to confirm the accuracy of information regarding leases.

A form of the estoppel certificate should be attached to the purchase agreement.
A major issue in the sale of an office building or other multi-tenant property is the percentage of estoppel certificates that must be returned to satisfy the condition, it usually being agreed that certificates must be received from tenants under certain major leases and a specified percentage of other leases. Seller may negotiate the option to give a warranty or Landlord's Estoppel Certificate to cover the estoppel certificates that are not received from the tenants.

The Purchase Agreement should specify that the estoppel certificates confirm all information given by the Seller with no material comments or corrections.

Warranties regarding compliance with zoning laws and building codes are virtually impossible to obtain from Sellers in view of the difficulty of knowing whether a building is in compliance. The usual compromise is to obtain a warranty that no written notice from a governmental agency that the property is not in compliance has actually been received.

Environmental warranties usually present serious negotiation problems.

Sellers should be willing to warrant that they, and their tenants, have not created any environmental problems. However, if an environmental investigation has been conducted, the warranty should be qualified by the contents of the environmental reports which will be provided to the buyer.

Environmental insurance may fill the void of some environmental warranties. It can take weeks to months to negotiate a policy of environmental insurance, so start early if it appears that this insurance may be required to close the deal.

If the Buyer is seeking to transfer some risk to the Seller, it may also be preferable to use an indemnity clause rather than negotiate a warranty that may be qualified by someone's actual knowledge.

Sellers should include a provision that if a Buyer finds a warranty to be inaccurate prior to the losing, the Buyer cannot close in reliance on the false warranty and seek damages post-closing. See Jue v. Smiser (1994) 23 Cal App. 4th 312.

IV - Even if warranties are given, the buyer's lawyer must advise the client to undertake a thorough study of the potential risks and liabilities associated with the acquisition.

While the client might focus on economic issues, such as the viability of the leasing market and comparable land values, the attorney should properly advise the client regarding the possible risks and liabilities which could be imposed upon the Buyer of the property.

Of particular importance is the need to communicate with the client regarding the client's expectations of what the lawyer intends to do and what the client will do itself or through its staff. It is particularly important to discuss the entire due diligence program with the client and the probable cost of the legal work involved.

Many lawyers don't perform diligence work that might be expected by the client because they believe. The work will be time consuming and the client will be unwilling to pay.

V - Special warranty and disclosure issues.

Undeveloped Land - - the Seller should make it clear he or she will not be responsible for any problems with entitlements or improvements to the land, and should provide that the Seller is selling the property subject to any unrecorded lien that may be created by a subdivision map or bonds to insure the completion of improvements, or that the Buyer should obtain its own bonds to complete the improvements.

Apartment Buildings - - warranties or representations about the number of units can give rise to litigation if any of the units has been "bootlegged" or is not legal.

Residential Property - - the C.A.R. form currently in use does not contain an "as is" provision or any warranties. The form does provide that the property is sold "7.A.(a)... in its PRESENT physical condition as of the date of Acceptance and (b) subject to Buyer's investigation rights..." It is up to the parties or realtors to negotiate a more comprehensive "as is" provision or any warranties. Care should be taken on behalf of the seller of a residence with respect to physical or structural problems. The following documents can be used to protect the Seller's interests:

The Transfer Disclosure Statement required under California Civil Code section 1102, et seq.

A rider to the C.A.R purchase agreement with a comprehensive "as is" provision.

What to Look For in a Chiropractic Consultant

In conversations with many chiropractors each and every week, I am amazed at how many do not have a chiropractic consultant or coach. All great athletes have coaches. All successful CEO's have coaches. If you take your practice seriously, you need one as well. As one of my mentors Brian Tracy says, "you need to learn from the experts, because you will not have enough time to learn it all on your own". I am going to discuss some of the key questions you need to ask before hiring a chiropractic consultant.

The first question to ask yourself, is the coach currently in practice? Many of the top consultants are now out of practice. In most cases, that is okay. However, I personally like to mentor and coach with those who are still in the trenches and are experiencing chiropractic practice today. I have been in practice for the past eleven years in Southern California, one of the most chiropractic competitive areas of the country. I have found that what works in marketing your chiropractic message in most areas of the country, usually has very little success in this Southern California.

The second question to ask is what is the focus of their coaching? For many of the consultants out there, a major emphasis is on acquiring new patients and marketing. Although this is a very important part of building a successful practice, I have found out by my experiences, that there is very little emphasis on running a profitable, efficient business and strategies for taxes, etc. Most chiropractors have never owned a business before, and the reason they became chiropractors was to help people. How many chiropractors do you know, who see a lot of patients each week, yet are struggling financially because of the lack of business skills?

Another question that you need to ask is who will actually be coaching you? Are you going to be communicating with the principle of the company, or will it be an employee of the consultant? I know from my experience a few years back, there really was no communication with the chiropractic consultant, and I had to deal with someone who was an employee and not even a chiropractor. Learning from webinars, seminars and tutorials is a very large part of most consultants programs. Are you getting great value for the cost of these services each and every month make sense?

There are many great chiropractic coaches who still practice today out there, so you need to do your research before making a very important decision for your practice future. When you make your decision, give it your full participation.

Carmel-By-The-Sea Ginger Shrimp Stir-Fry

Baby, it's brrrr outside. Here in beautiful Carmel-by-the-Sea we love seafood dishes paired with local white wine when a chilly autumn wind blows in off the sea. Light a fire, pop the latest NetFlix into the player, and snuggle in guilt-free with this delicious one-skillet meal that will make your day. But first, a soupcon of local lore.

Spanish settlers. Fishing immigrants, wealth, and tourism:

The Spanish settled Monterey that was the capital of California when first Spain, and then Mexico ruled the Golden State until 1850 when it became part of the U.S. Early 19th century Italian and Chinese immigrants started a booming fishing industry that helped spotlight the region. The first genuine U.S. resort was the Hotel Del Monte built here in 1880. It attracted the rich and famous until the Navy requisitioned it in WWII. It remains the Naval Postgraduate School.

The Del Monte's reserve with its famous 17-Mile Drive became the Pebble Beach Company of today owned by a group of investors led by Clint Eastwood, Arnold Palmer and Peter Ueberroth. Adjoining Carmel was incorporated from a portion of a Spanish rancho purchased by a wealthy Frenchman. Today, tourism is the Monterey Peninsula's main industry. People come from the world over to enjoy our outdoor lifestyle, clean beaches, fresh produce, local wines and healthy cuisine.

Carmel-by-the-Sea Ginger Shrimp Stir-Fry

1-cup uncooked jasmine rice
2-cups water
1- cup of dry white wine like a sauvignon blanc
1-large bag of frozen jumbo shrimp, or 16 oz. of raw
1-cup of apricot nectar
1-T cornstarch
1 T. fish sauce
3-cloves of garlic minced
3-inches of ginger root peeled and thin sliced
2-T. grapeseed oil
1 pound of asparagus, trimmed and cut into 2-inch pieces

Stir the rice, water and one-third of the ginger together in a medium saucepan. Cover and bring to a boil, then reduce the heat to low and cook for 20-minutes, stirring a few times.

Peel and devein the shrimp unless using defrosted, rinsed frozen shrimp. Toss lightly in a bowl with the cornstarch, then add the wine, apricot nectar, and fish sauce.

Heat the oil in a wok or large sauté pan. Add the garlic and remaining ginger, stir until golden for approximately one minute. Add the asparagus and stir-fry for two minutes until crisp/tender and move to one side of the pan. Drain the liquid from the shrimp into a measuring cup and reserve. Stir fry the shrimp until just opaque and then add the marinade and stir for an additional 3-4 minutes until the sauce thickens. March Madness Betting Tips

Now the brigade of recreational sports bettors line up at the window and provide, and sometimes take away, line value from us "Sharps" as March Madness is in full swing. It is apparent to me that one has to sidestep a few landmines along the way, as LESS is MORE when it comes to betting March Madness, both in the NCAA and NIT tourneys that are underway on Tuesday Night. The is plenty of parity, especially in the NIT tourney this year in college basketball. I can say without question, or many arguments that there are 5 or 6 teams in the NIT that could be round 1 winners in the big dance, and a few possible sweet 16 teams in there as well. Always look at road records and home records in NIT game match-ups, since they are played on teams courts and do not go to a neutral site until the semi-final games in New York. The home team always has an advantage, and one might catch a short line or two that has value.

High seeds in the NIT sometimes have a let down spot, since they were rejects from the NCAA tourney committee. Cincinnati comes to mind in that category, as well as SW Missouri State (RPI of 21) and Creighton. These teams for example, have first round byes and will be laying a decent number at home in their first NIT game, and depending on the line, it may be worth looking at the underdog in those scenario's. Maryland is just happy to be here, and they are a regional #1 seed, and Louisville, which also should provide a stiff test in their first game, so those big boys might be WORTH a look!

NCAA tourney trends are everywhere, I would not buy into all of them, look at the right here, right now. Who came limping in the tourney, and who came in hot and on a roll, I look to Kansas for example, 15-1 their last 16 and they won the Big 12 Tourney over Texas, who pounded them by 25 earlier this year? That is the question that makes the money. How about shooting percentage in away games on the year? I cannot stress enough free throw percentage, many games outcomes depend on it.

I have heard so much about #5 seeds versus #12 seeds. In the last 5 years #12 seeds are 10-9-1 ATS, hardly a money maker even against the number, but are always competitive. The BEST ATS scenario in round 1 has been #7 seeds versus # 10 seeds in the past 5 years at 13-7 ATS. California vs. NC State is in this scenario this season, Marquette vs. Alabama as well, and I could see both those #7 seeds making the hay in round 1. And last, but not least, #15 seeds have covered 65% ATS overall the past 5 years, and always a huge underdog. This fact lies within the coach of a #2 seeded team resting players after the game is decided early on, and backdoor covers are apparent in the right scenario. Check the two highest point getters and do your homework and find the best value in that scenario.

All in all, it should be a great tourney season, and there will be a Cinderella team or two both in the NCAA and NIT tourneys, and there will be a monster upset or two in round 1. Pick and choose your teams wisely, use sound money management and do not get caught up in all the hype or what Billy Packer or Digger Phelps says, and do your homework and look for real value and tangible items to handicap in March Madness, because that is what the pro's do, I assure you.

People Eat With Their Eyes - Menu Boards Are Important

The first place that customer's eyes are searching for, after he is placed on his seat in any restaurant is "the menu board". Any restaurant's core purpose is to serve food and it is the main purpose every one goes there for. Menu board therefore, becomes the most targeted sight of all the customers who come and dine.

There are few ingredients what you menu box must be having.

1 It must be distinguishable and must be placed at the place where its visibility is maximum. Mostly menu boards are placed above the counter in order to serve the same purpose.
2 Secondly, menu board must present all of the cuisines restaurant is offering, preferably with the price written on it.
3 It must be distinctive with the restaurant's logo printed on it.

There are three types of menu boards. The most famous among all is the PVC or Vinyl based menu boards. In these boards menu is printed digitally on a vinyl sheet. This vinyl sheet is then placed on a board. That board has the lights, either inside or outside the box in order to enhance the visibility of the board. However, few restaurants are using vinyl sheets only to serve the purpose of Menu board.

Second type is spectacular Menu boards, in which lights are used to instead of PVC or Vinyl sheet.

The third type of Menu boards is the digital menu board. This menu board is relatively new and a digital screed installed with pre coded information is used to serve the purpose. Digital menu boards, because of moving images and great picture quality are rated better as compare to other menu boxes. Digital menu boxes have more visibility and their reach is maximum. However, they have more (but one time) cost attached to them.

Menu board can also be used as a very efficient marketing tool. Along with all other media options, your menu board can serve the communication purpose well. As it is sure that anyone who will visit the restaurant will look at the menu board for once, therefore, the reach of the advertising messages will be enhanced if they are displayed on it. Secondly, you must be conscious about the quality of your menu board. Your menu board can be used very effectively in order to increase your sales however; it can detract your customers if it is of inferior quality.

There are three main purposes that your menu box must fulfill. First of all it must be capable of influencing your customers to stand up from their seats in order to order something; you can do it very easily by promoting the daily specials. Secondly, your menu board can lead your customers to high priced dishes. However, it requires little attention and understanding of your customers. In the end your menu board must be of good quality in order to enhance the image of your restaurant. Wagon Wheel Restaurant Review, Escondido California

The Wagon Wheel has been an institution in Escondido, California for over 40 years now. On what seems to be only the second set of owners in it's history the restaurant gives patrons the chance to step back in time to enjoy a home cooked meal in a comfortable red leather booth while paying prices that would remind you more of 1985 then 2005.

I recently had the opportunity to enjoy dinner on a Friday evening at the Wagon Wheel Restaurant in Escondido, CA. Located off of the 78 Freeway it is easy to locate with plenty of parking both in front and in back, an old wooden building houses one of the oldest running restaurants in San Diego county.

After finding my way to a corner booth I started by ordering a soda to drink, the restaurant does not currently carry a liquor license in part to keep to their family friendly attitude. I then found a special board (located just above the entrance to the kitchen and written in chalk).

I ordered the baby back ribs special which was accompanied by a salad to start, side of potatoes (I chose French fries), another side dish (I chose vegetables), as well as a choice of bread either roll or cornbread.

So how was everything? Extremely good. The salad was the classic house salad which was a nice place to start. The ribs came out and had clearly been cooked at a low temperature for a long period of time, the sauce was perfect. The French fries when combined with my wife's onion rings ordered showed off the best of 1950's American cooking. Lightly battered and fried when it was ordered and served piping hot. Lastly I found some space for dessert as there was an old portrait above a window of a piece of cherry cheesecake. To put it in a word: splendid.

I hope anyone living in San Diego county or south Riverside county will consider the Wagon Wheel restaurant in Escondido next time they are looking for a restaurant to visit. As opposed to the generic chain restaurants like TGI Friday's, Chile's, Applebees or Denny's you'll be paying less while getting much better (and more) food from a family owned restaurant. I always enjoy being able to stop in say hello and be able to have an owner there working the restaurant and making the food. Personally, I'd rather spend my money in a restaurant where I know the family that I'm supporting, as opposed to a large corporation to which I have no connection with.

The IRS is a huge agency and the staff is divided into a number of different areas as you would see in most companies. The revenue officers form a certain roll that has become legendary because these are the people that taxpayers fear - but should they?

Ah, but there is another side to the revenue officer. One of the major frustrations in dealing with the IRS is you tend to get transferred around to different people. Having just one part to communicate and negotiate with can often be key to resolving a dispute. A revenue officer is such a person. They can settle tax disputes, withdraw punitive collection tools like garnishments or liens and agree to extended repayment schedules. This means their involvement in a case is often ultimately a positive event.

What should you do if a revenue officer is assigned to your tax dispute? Well, the first step is to get professional representation. The appearance of one of these individuals means the IRS is giving priority to your issue and that usually means it is going to be very aggressive in the collection effort. That is not a good thing for you, so it is vital you take steps to protect yourself.

ATVs - The Most Dangerous Vehicles

All Terrain Vehicles, ATVs are some of the most dangerous vehicles ever marketed to American consumers. They are notorious for frequent rollovers, even at very low speeds and on very slight grades.

Hundreds of ATV drivers and passengers have been injured or killed when their vehicle rolled over. The most frequent injuries, including fractures and crushed limbs, have been to riders' legs, ankles and feet. The injuries have frequently been so severe that amputation has been required. Drivers and passengers have been killed when their ATV rolled over on them and crushed them. Because of their smaller size, children are especially vulnerable in ATV rollovers, and many children have lost their lives from riding in an ATV

Safety on ATVs has been a major concern since Honda introduced the first ATV to the US in1971. The US Consumer Product Safety Commission started keeping statistics on ATV injuries and deaths in 1982, and has documented more than 2 million injuries in ATV accidents, and 8000 deaths. In 2004, the latest year for which statistics are available an estimated 136,100 ATV-related injuries were treated in US hospital emergency room, and 767 people died in fatal ATV accidents. In 2005 the risk of injury was 171.5 injuries per 10,000 four-wheel ATVs in use. The risk of death in 2004 was 1.1 deaths per 10,000 four-wheelers in use.

Risks for Children in ATVs Children under 16 are the most vulnerable group of ATV riders, comprising more than a quarter of all ATV injuries and deaths. The American Academy of Pediatrics has called ATV use by children "the perfect recipe for tragedy," and in 2000, the Academy made a statement recommending against the use of ATVs by children under 16, saying, "The safe use of ATVs requires the same or greater skill, judgment, and experience as needed to operate an automobile." The American College of Orthopedic Surgeons, whose physician members see the outcomes of children's accidents in ATVs calls children's use of ATVs "a significant public health risk."

The costs of these ATV injuries and deaths are substantial, not only to the families whose loved one is injured or killed, but to the general public. The US Consumer Products Safety Commission has estimated that taxpayers and employers pay more $3 billion a year in medical expenses for ATV injuries through government and private insurance

ATV Industry Leaves Safety Up to Riders Safety issues haven't put a dent in ATV sales. ATV's are now a $5 billion dollar industry in the US, and the ATV manufacturers have even created their own organization, the ATV Safety Institute. The institute acknowledges that ATV's can tip and roll over, but it rolls the responsibility for accidents back to drivers. If the driver observes safe driving principles, it contends, accidents are few and far between. The implication: serious and fatal accidents are the fault of the drivers.

The Consumer Product Safety Commission has not tested a single ATV for stability since 1991. Purchasers and users of ATVs now on the market must take the manufacturer's word that their vehicles are safe, for many ATV drivers and riders, that assumption has turned out to be dangerous, and sometimes fatal.

Chaplains Aide, Prison Ministry - Steps for Involvement

The first step to take is a prayerful examination of your motives. God wants a wholehearted dedication and a singleness of purpose from His followers. The volunteer minister to prison inmates is entering into an arena of spiritual battle. It is important to count the cost. Examine this in light of the impact on your family and friends. Recognize that the commitment in time alone will involve sacrifice. Be sure your family is behind you in your decision. You must be motivated by a love for hurting, misunderstood, often dysfunctional, and rebellious individuals.

Each of you is reading this book for a different reason. Some of you may have loved ones who are or have been incarcerated. God has put a burden on your heart to help others as you received help or to reach out to other inmates to repay what someone did for your loved one.

Others of you may have been introduced to prison ministry through the visiting room of a prison or jail. Maybe you were incarcerated yourself and now have a call to reach out to the hurting men and women behind the walls. You may have the gift of evangelism and feel called to use this gift to reach prisoners with the gospel message. Whatever your motive, it is important to recognize the cost in time commitment and in personal dollar investment.

It is important for you to understand your strengths, gifts, skills, interests and desires to decide which volunteer ministry you are best suited for. This will help you best use your talents, time, and energy as you assume responsibilities that will be a blessing to others and bring a sense of reward and satisfaction to you personally.

Next you will want to identify the correctional facilities in your area. For example, in Alameda County, in California, we have Santa Rita County Jail, Juvenile Hall, Duel Vocational Institute, and city jails in each of the major cities in the county.

In large population areas you may find several classifications. There may be city jails, county jails, juvenile facilities, state and federal prisons. Each of these facilities serves a different and unique roll in the field of corrections.

Each of these facilities serves a different function. Opportunities for ministry will vary in line with the needs and offerings of the Office of Volunteer Services or the Chaplains in charge.

In larger institutions it will be necessary to contact the Director of Volunteer Services to find out what opportunities are available. You may in turn be referred to the Chaplain's office for service in Christian ministry. You will then be provided with the necessary application forms and told of any additional requirements for volunteering. In most cases it will be necessary to attend some prerequisite orientation training.

The next step is to align yourself with an organization that will provide you with an open door of service. There are many national and local organizations using volunteers in the work of prison ministry. Visit the inter-net for a listing. Prison Fellowship, Match II, and Friends Further Out are just a few of the ministries you will find. Your church may have its own jail and prison ministry.

I have personally been involved with Follow Up Ministries, Inc. of Castro Valley, California. This group was founded by Glenn L. Morrison in 1956 and has branches in several cities throughout the United States. FUMI provides regular opportunities for training and orientation in working with the inmates in correctional facilities.

After the initial orientation, a plan of mentoring takes the volunteer a step further. Opportunity is given to work alongside a trained volunteer in reaching those behind the prison walls.

It is the aim of this ministry to produce disciples. The goal is to train the inmate to go back into the cellblock to win their peers to Christ. This is the beginning of the multiplication process of New Testament discipleship.

Rehabilitation programs within the correctional facilities are aimed at job training and self-management skills. The correctional facilities in your county may provide opportunities for volunteer service in this area.

While rehabilitation and religion play an important role in the life of many prisoners, there is no substitute for God's work of regeneration. It is
the challenge and calling of the chaplain and the Christian volunteer to bring the redemptive message of the cross of Christ, new life, and hope to those behind the prison's walls. We are called to introduce the inmate to the claims of the Gospel and to Jesus Christ personally.

Prison ministry is unique. It is a ministry of careful listening and compassionate healing. We must be careful to withhold judgment. By ministering to the incarcerated we can help individuals discover forgiveness and reconciliation through God's love. The church can provide channels of communication within both the local and the prison communities.

The testimonies of those who visit the incarcerated are consistently warm reports of inmates eager to have contact with the world beyond the walls and eager to learn principles that will help them take a stronger stand in their walk with the Lord. As you minister to an inmate you multiply your ministry as he/she return to the cellblock to evangelize and disciple others.

As a Christian, it is important to remember that the key to the success of any of the programs already mentioned is the experience of regeneration. We are called to introduce the inmate to the claims of the Gospel and to Jesus Christ personally.

Because you are entering an arena of spiritual battle, it will be important for you to recruit some prayer warriors to assure success in your new field of endeavor. If you are planning on making this a full time ministry it may also be necessary to enlist some financial supporters as well.

The Jimi Hendrix Experience

A friend of my named, Bob, was staying in Los Angeles in the spring of 1968 when I was seventeen years old. Bob asked me, "Would you drive me to a rock concert at the Swing Auditorium in San Bernardino, California? I'll pay for the gas and buy you a ticket to the concert if you'll take me."

"Sure", I replied, "Who's playing?"

"It's a really far out guy named Jimi Hendrix. He's the most bitchin dude I've ever heard. His group is called The Jimi Hendrix Experience."

"I've never heard of him, but that's okay I always like to see the latest rock-and-roll. I'll need to get a map to figure out how to drive there. That's a really long drive and will probably take about two hours. "

Bob was ecstatic; "Far out, I will score the tickets right away. Later."

That week I spoke to a friend of mine named Clay and told him, "I'm going to be taking my friend Bob to a concert out in San Bernardino to see some guy named Jimi Hendrix."

Clay exploded with, "You've got to take me with you. I just love Jimi Hendrix's righteous music. I'll buy a ticket and help pay for the gas if you will take me?"

"Solid," I replied, "I always like going to a concert with a lot of people. So get your ticket and meet at my house this Saturday. I'm sure Bob will have no problems about your jamming with us."

"I'm stoked. Catch you on Saturday," Clay said.

The three of us gathered at my house early that Saturday afternoon, Bob had brought his 35 mm camera to record the event. We set out for our rock concert journey in my 1967 lime green Ford Mustang. Bob kept stating over and over, "Hendrix has just got to play my favorite song "Purple Haze" it's the grooviest song I've ever heard. I can't wait for you to be able to hear that song."

Many hippies with their long hair, beads, feathers, leather and non-conformist attitude of peace and love, were gathered outside the Swing Auditorium, which looked like a high school gymnasium building. The three of us were far from being hippies; we were middle class not willing to live the free lifestyle, usually drug laden, that so many flower children were involved in. It was a typical rock concert to me except it was taking place in a very out of the way location; I was use to concerts taking place in Hollywood. My main concern at that moment was remembering where the car was parked so we could find it quickly after the concert.

The three of us entered the auditorium and were disheartened to see that it was open seating. There were no assigned seats so it was a free-for-all on where you sat. I really hated this type of concert seating because if you got up to go to the bathroom you would lose your seat or your place in the crowd. The auditorium had space for about 1000 people. Bob said, "I want to get as close to the stage as possible. Let's make a beeline to the front of the stage." I looked up and noticed a poster hanging next to the stage. It was a picture of a young black man with crazy hair, looking very arrogant and sexy. I only liked rock-and-roll music so I was beginning to think that I was going to hear black soul music.

There were folding chairs surrounding the outer perimeter of the stage. Toward the front of the stage there was no chairs, it was just an open floor for people to stand on. Bob led the two of us to the very front of the stage, pushing and shoving whoever was in his path. I was glad that there were two young men with me so that I would not be beat up or hassled by the fans. I knew that mild hippies could go berserk without too much provocation from my previous experience of being attacked, trampled by fans, and beaten up by police at previous concerts. It was impossible for us to talk because of the loud noise of the crowd. We staked out our positions at the front of the stage.

The fire marshal came out and made an announcement, "This concert is going to be canceled due to the fire hazard of so many people unruly in this auditorium. If you don't sit down immediately we will close down this concert."

Suddenly this black man came on to the darkened stage and yelled into the microphone, "Shut the fuck up, I want to play." The entire auditorium went silent and everyone sat down immediately. "Who was that?" I couldn't see who it was because of the darkness on the stage; I had never heard anything like this being said to an audience before.

The fire marshal came back and said to the crowd," OK because you're all cooperating we will let this concert continue."

The lights came on the stage; there were already musical instruments set up just waiting for the performers to bring them to life. The crowd started going crazy with excitement. The three of us were being pushed very hard into the wall of the stage. The stage was approximately five feet high and I felt like a tomato being squished against the stage, I couldn't get any closer unless I was on the stage. I was slightly separated by a few feet from Bob and Clay, but they were still within eye contact, it reassured me to see their faces as any moment I could be pushed down or trampled by the body's pushing me into the stage.

From offstage came these two white men with crazy Afro's looking like tendrils reaching into the universe, one sat at the drums, the other picked up a bass guitar to play. The anxiety of the crowd increased when out came the same black man I had seen on the poster. "So this is Jimi Hendrix," I thought to myself. He was wearing maroon colored velvet pants with an embroidered jacket, beautifully spaced out hair and carrying a white guitar. He was smiling and spoke to the crowd, "Good evening everybody, it's really cool that you all shut up so I could play. I just want to groove with you this evening. So let me just, ah, get you experienced." I recognized the voice as the one who had said earlier "Shut the fuck up I want to play".

The moment Jimi strummed the first note of the guitar the audience went crazy with excitement and I realized I was not going to see a Motown soul artist. I maintained my place next to the stage as the audience was so entranced by the music they were no longer pushing and shoving. Jimi started playing a song called, "Fire". The sounds emanating from his guitar were like a foreign language to me, mysterious, beautiful, different and dangerous. Jimi contorted his face with each chord movement; it was like seeing the chords even if you didn't know them. The music was so loud it physically penetrated my body. It was as though I had become the instrument that he was playing. I was moving to each sound he made without any control of my body.

The next song he played changed my life forever; it was called "Purple Haze", just like Bob had promised it was one of the greatest songs I had ever heard. During this number the time came for his solo, Jimi started playing the guitar with his teeth! Jimi didn't miss a single chord, the music was perfect. Never had I seen anybody play the guitar with his teeth. I was mesmerized by this performance. Next he flung his guitar behind his back and continued to play, never missing a note, his face was ecstatic. I did not know any of his music so each song was a revelation to me. To my left I saw Bob clicking away on his camera-taking photograph after photograph.

Just when I thought I had seen everything Jimi surprised me further, during the song "Are You Experienced?" Jimi started his solo and went down on his knees with his guitar between his legs, moving it back and forth along his crotch, simulating masturbation. I had never seen anything like this in my life. I couldn't believe what he was doing in front of the crowd of people. It was as though his own music sexually stimulated him. When Jimi had finished the masturbation simulation he stood up and went over to the large speakers with his guitar in front of him. Jimi started slamming his body and the guitar up against the speakers as though he was having sex with them, never missing a chord of music. The more intense the music became the faster and harder he slammed into the speakers, it was as though the music was both ecstasy and agony for Jimi.

My body continued to vibrate as Jimi played on for the next 45 minutes. I could not consciously think as the music played, every fiber of my brain was filled with music the likes of which it had never experienced before or since. There were moments in the music where I felt like I was falling backwards in time, and then Jimi would propel me forward into outer space. It became evident why the group was called "The Jimi Hendrix Experience"; there was no way you could listen to the music without experiencing your life differently from that point on.

When the concert was over Jimi said to the crowd, "It was really groovy tonight, I'm glad I was able to share my music. I wish you all peace and love." When he exited the stage the entire auditorium went ballistic begging him to come back, which he did. His encore was the climax of the evening for me, as he played "The Star Spangled Banner" unlike any version I had ever heard before. I could just feel the bombs bursting in air and the bullets flying by, as the sounds emanated from his guitar. How this one man captured the sound of war in his guitar was amazing, the mark of a true genius.

Jimi blew kisses to the audience as he and his band exited for the last time. He left like he entered, smiling. This man seemed to truly love what he was doing at that moment. I was still feeling stunned by this experience when Bob and Clay joined me. They were just delirious about the music. As we were exiting the building there were vendors selling two different albums by Jimi Hendrix. I had to purchase the albums right then and there; I did not want to go home without being able to take a part of that experience with me.

My ears were still ringing from the vibrations of the music. The three of us were very quiet on the drive back home. We were just letting what had happened to us absorb into our beings; we each knew that we had been changed by this experience. We would never view the world and our surroundings the same after this. You cannot go back to being a regular high school kid when your whole body just went through an alignment that none of your peers had ever witnessed or felt. Jimi Hendrix said it best when he stated that once you heard his music "You'll never hear surf music again". Meaning that you cannot go back to the easy California lifestyle when new sounds and vibrations have expanded your mind as well as your body.

This point was brought home to me the next day. I took my two prized Jimi Hendrix albums to my girlfriend Donna's house so she could hear the incredible masterful music I had just been enlightened by the night before. "You're really going to like this musician. He is like nothing you have ever heard before. I can't get over this concert," I told her while placing the album on the record player.

She sat quietly through the first two songs before she exclaimed, "Turn that music off. It sounds like Martian music." She wanted her music to be simple and uncomplicated. I now resonated to a different vibration. I knew I was not the same young girl I had been before. My change was mirrored to me by my girlfriend's reaction. My consciousness had been altered forever by the magic of Jimi Hendrix's music.

World renown Swami's Surf Break was made famous by the Beach Boy's in their 1963 classic rock and roll song "Surfin' USA." Swami's is only two blocks from downtown Encinitas along Old U.S. Highway 101 and still draws the finest surfers in the world on a daily basis, making for wonderful surfer-viewing from the cliffs above. Big wooden staircases with built-in benches  bring you down to the beach. Picnic tables at the top are a wonderful place to sit and take in the sweeping views of the ocean and witness some phenomenal surfing feats. 
 
Take In A "Talkie"
 
If you wax nostalgic for an old-time "real" movie theater, take in a film at La Paloma Theatre, where they feature first-run hits, "art" movies and surf/skate/snowboard/music film premieres. It's THE place to see Rocky Horror Picture Show. La Paloma Theatre was built in 1928, and was one of the first theatres to show "Talkies" in 1927 with the Warner Brothers film "The Jazz Singer" starring Al Jolson.  
 
Meditate At A Temple

High School Choices

Are things not going so well in public high school? Do you know your school choices? Are you on the brink of dropping out? Have you already dropped out? You are not alone. For example, in California, graduation rates are at their 10 year low. In the city of Detroit, only 25% of high school are getting a diploma. Something is wrong here.

I will give you my hit on what the problem is, and some solutions to consider. First of all, the "No Child Left Behind" program is having exactly the opposite effect from what was intended. This is a program that was intended to give every high school student an equal chance of getting a good high school education. In real life, "No Child Left Behind" has become a huge drop out machine.

Now that the program is maturing, some schools seem to be performing better, and students scores on the tests seem to be getting better. Wrong. What is actually happening is that slower students are being eliminated, and only the scores of the higher scoring students are being measured. In my state it is well known that drop out data is being disguised due to pressure on schools to perform well and get federal funds. The way it is done here is to not count as a drop out, any student who leaves school and states that he wants to get a GED, be "home schooled", or go to an online school. They do not know, and do not care if that low scoring student actually goes on to get a GED or whatever. All the high school cares about is that he will no longer be counted "against" them.

To me, the worst outrage is that the "No Child Left Behind" program is functioning as a filter, to separate out those kids who came from relatively more privileged, and stable backgrounds from those who have family, economic, and social problems. I know that there are children who defy all odds, and excel, but overall this is the truth. Minorities, you step over here, all others step over there. This makes me very angry. Why has President Obama allowed this to continue. My suspicion is that it is due to his poor choice for Education Secretary, Arne Duncan. Mr. Duncan is career executive who has never taught school, and would probably die of fright if he ever went to an inner city school. Duncan is a free market fanatic, and believes in holding schools, and students "accountable".

I am all for having people take responsibility for their own actions, but there is something larger at play here. I will give you an example. Here is my own story. My step daughter just dropped out of HS. This is not something I approved of or encouraged at all. I am very upset about it. In her earlier grades, she was held back twice. Being held back twice increases the chances of dropping out of school to over 90%. Somehow I thought she would defy the statistics.

My step daughter is Vietnamese. In her early school years, she had a difficult time catching up to native English speaking students. In high school she began to do well. She made the honor roll. The problem was that just after making the honor roll, she failed the state exams... again. How is it that a student who is awarded the honor roll by her high school can fail the state exams? This means that she was getting the maximum that she could from her school, but that school was substandard, and was not preparing her for the standardized tests. It also means that we had little confidence in her schools' ability to help her prepare for retesting. So, here is what we decided.

We enrolled her in an online high school. After extensive shopping, we selected a school that is medium priced, has a good curriculum, and good accreditation. We avoided schools that were attached to the public school system, and the state exams for obvious reasons. The school that we chose was National High School. If you are searching for an online high school, you will have a lot of choices. There are more than 200 of them advertised. Some are very expensive, costing $1000 per course. Some are free, and sponsored by the state.

Carwash Fundraisers are Being Banned in Some Cities for Environmental Reasons - Case Study

Are carwash fundraisers being banned across America or in only some cities on the West Coast? Often, environmental regulations start in California and work their way Eastward, sometimes skipping the middle and jumping across and then filling in the red states later. We can all see this from observation and it stands to reason why this occurs. Why are carwash fundraisers being banned in California, Washington State and other places?

The International Carwash Association, Western Carwash Association and Puget Sound Carwash Association have been culprits, trying to coax environmental agencies to stop car wash fundraisers that compete with their members. In many places carwash associations have even attempted to get home car-washing by car owners banned as well.

Is it because they are greedy and want the business? It appears that it is economically motivated, not really environmentally motivated. Do Fixed Site carwashes save water? What about the drought in many cities? Well, carwashes claim to recycle their water and state that they are good stewards of water supplies, still the average car wash coin op using 8 gallons, and 24 gallons of fresh water are used at a touch-less or roll over carwash.

They do not recycle it all and many use RO-reverse osmosis rinse systems that use 3 gallons to make one gallon of spot free water. Some use the left over with the soap, but not all. Indeed, carwashes are not nearly as efficient as you might think. If they use so much water, why are they not shut down?

Most cities in Level II drought have plans to stop car wash businesses or ration them. In the 1990's Santa Barbara did this, the city put in a desalination plant, but the rain came before it was finished, they sold the desalination equipment to Saudi Arabia. Right now in some cities in TN, GA, SC, NC (Raleigh-Durham Area), they have shut down carwashes. There are places in the Nation, such as the receding Ogallala Aquifer where wells are dry.

Water supply crisis in America, well it is a huge issue, but the problem is mankind does not conserve our precious resource. California fires are also a huge usage, fire fighting consumes lots of water. California needs to act with a real long-term solution and not cut out carwash fundraisers for the community. California needs desalination for San Diego, Riverside, Orange Counties, the Colorado River cannot handle it with all the growth in Clark County Nevada, PHX, San Diego and Riverside.

The Online Think Tank thinks "Camp Pendleton" land is perfect for a Desalination Plant, run from Ocean Wave energy for Southern California. The water crisis is real and with the waste and growth, it even more serious. Still you can wash a car with a pressure washer without scratching using only 3.0 to 5 gallons fairly easily, yes SUVs and Minivans too. So shutting down carwash fundraisers makes no sense at all.
