Effortless Pool Party For Kids and Grown-ups Too!

There is something about planning a party at the pool that alternately evokes images of lazy days and frenzied terror. Going as a guest to a pool party sounds positively lovely. All you have to do is soak up the sun and strategically position the towel so you look your best without appearing to actually orchestrate it.

However, if you are the host or hostess it is another matter entirely. You are now the party planner and the success or failure of the party will fall on you. Is planning a simple pool party difficult? What if you get there and you have forgotten the crucial ingredients? What should you serve? Will the food hold up on a hot day? What if... what if... what if...You might as well start to worry about lightening striking on a clear and beautiful day in southern California. It's not going to happen and neither is the other stuff. And if it does you'll just deal with it.

But we have to admit, a good party plan makes everybody feel better and we have a fool proof plan for you.

1. Here is your menu:

o Peanut butter and jelly sandwiches (is there a kid around who doesn't love these?)
o Deli roll ups (recipe to follow) for the adults or adventurous kids
o Carrot sticks, celery
o Apples, grapes, cut up cantaloupe or whatever your favorite fruit is
o Chips, Trader Joe's Low Fat Pretzel Sticks and store bought dips
o Toll house chocolate chip cookies or Rice Krispy treats
o Drinks can be as simple as bottles of water
o It's easier to store everything in a nice cooler.
o Paper plates & napkins
o Trash bag

2. Putting you party in the cooler keeps everything cold and you don't have to worry about the food not holding up well. It has the added benefit of keeping all your food together in one place. If you don't have a cooler just put a few bags of ice in with the dips.

3. Bring pool toys which can be purchased at your local grocery store, drug store or any discount store like Tuesday Morning, Big Lots or the local 99¢ store . There are great bargains at those store where you don't have to spend a lot of money, but at the same time you can get a variety of pool toys. Blow up rafts, inner tubes, diving toys and squirt guns are great for the pool party. Don't forget towels, sunscreen and extra shirts

4. That's it. Get in the water, cool off and HAVE FUN!

Recipe for Deli Roll Ups: Makes 6 Rolled lavosh)

Package of lavosh (12X18 rectangle) Found at Trader Joes, Wholesome Choice, Whole Foods and other markets

Basil Herbed Cream Cheese (recipe below )

8oz package cream cheese, softened
6 T. mayonnaise
2 tsp. Italian seasoning
1-2 T. finely chopped fresh basil
1 tsp. granulated garlic
Mix above ingredients until smooth
Turkey breast and ham, sliced (3 slices to cover each lavosh 2- ham 1 turkey or 2 turkey and 1 ham)
Tomato, sliced- cover the lavosh (about ½- ¾ tomato per lavosh)
Red onion, finely chopped
Green leaf lettuce, washed and thoroughly dried

Here's how to Assemble the Roll-ups

Lay Lavosh on plastic wrap
Divide basil cream cheese into 6 parts and spread on lavosh.
Add thin slices of turkey breast and ham 2 turkey, 1 ham or 1 turkey, 2 ham
Add tomato slices
Sprinkle with chopped onion
Add the lettuce on top ( tear leaf lettuce and put on top of all ingredients
Roll up tightly and wrap in plastic wrap.
Chill until firm or overnight.
Slice at an angle (which makes them much prettier, approximately 12-slices per roll), Arrange on a large paper plate and serve.
Easy and yummy.

Solar Power Cost Effectiveness

Solar power is still not cost effective with photovoltics (PV) costing in the neighborhood of 30 cents per kilowatt and 20-22 cents per kilowatt for solar thermal plants. Taxpayers subsidize this inefficient roll out of solar panels by way of government (on the backs of taxpayer) subsidized incentives instead of waiting for the technology to improve.

Solar thermal essentially uses mirrors to heat water or other liquids, turn it into steam that cranks turbines to provide electricity. PV, by contrast, takes the rays of the sun and converts it into electricity without water or a turbine.

There is hope in a company called Ausra (manufactures a solar thermal product) who have developed technology that cuts the cost of solar thermal to 8 cents per kilowatt. They use batteries to provide power when the sun isn't shining.

Solar panels for PV use the same expensive silicon that computer chips do. The shortage of the silicon is driving up prices. It is not clear if or when at all that solar power will become cost competitive with oil, coal or nuclear power.

Glam Up Your Boyfriend Blazer With Fashion Jewelry

Tall:

Peach Cobbler Recipe With Fresh Peaches

It's not too early to start thinking about fresh peaches. Actually, some of the California peaches are in the supermarkets already; however, their quality is somewhat uneven, what with being picked early and shipped for hundreds or thousands of miles. Still, even now it is possible to find ripe peaches with good flavor. In a manner of weeks, however, local peaches all over the country will begin ripening and crowding the shelves of departments and farmers markets everywhere.

Haven't we all been experimenting with Peach Cobbler for some time? Well, this recipe is the final result. It is loved by all and it is extremely delicious. We owe it to ourselves, then, to experience peaches during their summer prime in as many ways as possible. And one of the best, most time-honored ways to enjoy peaches is in a peach cobbler.

Ingredients for Peach Cobbler include 8 peaches cut into thin wedges after being peeled and pitted. 1/4 cup each white sugar, brown sugar and boiling water; 1/4 teaspoon ground cinnamon; 1/8 teaspoon ground nutmeg; 1 teaspoon fresh lemon juice and 1 of baking powder; 2 teaspoons cornstarch; 1 cup flour; 1/2 teaspoon salt; and 6 tablespoons unsalted butter that have been chilled and cut into small pieces. Mix 3 tablespoons of white sugar with 1 teaspoon of ground cinnamon.

For fresh peach cobbler, preheat your oven to 425 degrees F (220 degrees C). Then, in a big bowl, combine the peaches, 1/4 cup of white sugar, 1/4 cup of brown sugar, 1/4 teaspoon of cinnamon, lemon juice, cornstarch, and lemon juice.

Take a large bowl of combine flour, add quarter cup while sugar and another quarter cup of brown sugar, baking power and salt and blend the mixture by a pastry blender, toss to coat evenly. Then pour into a 2 quart baking dish and bake in preheated over for 10 minutes until the mixture resembles coarse meal.

Mix in the water until they are slightly combined. Take the peaches out of the oven and cover them with topping by the spoonful. The sugar and cinnamon mix should spread evenly over the whole cobbler. Bake for half an hour, or until the topping turns a delectable golden color.

California Dreamin' - The California Due Diligence Process - Are You Ready?

If you have ever filed an unclaimed property report with the state of California you know what I am referring to and if you haven't but you filed a preliminary report in June with the State you are about ready to life the nightmare of California's due diligence process. Just last month you were asked to submit a preliminary report to the state of California. This report was a list of all the companies and individuals that your Company, at least according to your books and records, "owes" unclaimed funds.

Well, since June California has been very busy. The State has been reviewing that list, checking it twice, and comparing it against tax records and other resources for the purposes of locating these "owners." The result of all this effort is in about a month or two they will be flooding the state with letters from the California State Controller. These letters will notify these folks that there is potentially money owing to them and if they wish to claim it they need to contact YOU to get their money.

Now, like my mother always said, there are two sides to every story, the problem and the solution.

The Problem: This is going to create CHAOS...phone calls and emails will begin flooding in and will be routed to whomever you listed as the "contact." Hope it wasn't the CFO. Many of the recipients of these letters will be placed in a state of utter confusion. However, once they realize this is about money, they suddenly need it immediately.

The Solution: An immediate solution is to get another job. Now while this is tempting, it is not very practical. The second solution, prepare for the deluge. Here are some additional recommendations.

1. Beat them to the punch... send out your own letter. Not surprising, the letter that California sends is very confusing. Remember KISS? Well, let's keep this really simple. Send out your own letter ahead of California. Now what this will cost you in postage, it will save you in lost time answering phone calls and responding to faxes. The letter should simply indicate that the individual will shortly be receiving a letter from the California State Controller notifying them that they may have funds owing to them from your Company. If you wish you can also indicate that this has yet to be verified and the final report is due to California in November.

I would STRONGLY advise you provide a phone number that individuals can call with any questions. Now, you can provide detailed instructions on the voicemail, but many will still have questions so I advise you have a real live person answering the phone. I discuss this in greater detail below.

Please be advised there are NUMEROUS steps you can take prior to sending California the list in June that can mitigate the number of records, the inaccuracy of records, etc., which have a direct impact upon the pain you will feel during the due diligence process. These will be discussed at another time...I promise.

2. Man the battle stations. As I mentioned above, the letters that California sends out are very confusing. Once they see a phone number, most people stop reading and just dial. Their question, "I got this letter what does it mean?" Or, "This letter says you owe me money." The key is you and hopefully, your team, must be ready for the phone to start ringing. As I mentioned, the phone that will start ringing is the one who is as the contact on your preliminary report. If it was the Vice President you may want to remedy that situation very quickly.

Unfortunately, I can't wave a magic wand over this one. Below are some suggestions based upon lessons learned the hard way...experience.

(1) Answer the phone; don't let the calls pile up. It's amazing how quickly some people can get in contact with the CEO of the Company demanding their check.

(2) Have a process for responding to the faxes, they pile up as quickly as the phone calls. Similar to the phone calls, they go to the fax belonging to the contact.

(3) A phone log is not necessary, as I mention below, you will ask for verification by receipt of the fax.

(4) DO NOT PROMISE WHAT YOU CANNOT DELIVER. I can guarantee if these folks do not receive a check quickly they will call back. It amazes me every time...they didn't even know about the check and suddenly the electricity is going to be shut off if they don't receive their money. Tell them that after the final verification process if they are owed the funds when they can expect to receive their checks. BE REALISTIC! Otherwise you will get to know some of these people so well you will be exchanging holiday cards.

If you do not have the capability to handle the deluge, consider outsourcing this process. It generally only lasts about 1 - 2 weeks. I can assist in identifying resources.

3. Keep score. It is essential that you track all the information coming at you. Remember these are responses to your preliminary report. If you make payments in response to these letters I am fairly confident you don't want to also pay the state, although California certainly needs the money.

Once again, I wish I had an easy answer...I don't, but here are some suggestions.

(1) Require that those requesting payment fax or mail in the letter they received from California as verification. You will need to maintain these faxes as proof that a request was made for payment. If possible you should attach a copy of the issued or cashed check, depending upon the size of the Company. If this is not possible, a listing of checks issued from AP would suffice. If the dollar amount requested is over a certain threshold you may want to request proof of identification.

(2) Now you may ruffle some feathers, but once you receive the fax or letter you may want to send out your own letter requesting verification that funds are owing to the individual or company.

(3) If you have reporting software you most likely have the capability of tracking responses to due diligence letters. If you have reporting software and you have not taken advantage of this function, reach out to your provider. (If you would like to know about reporting software, give me a call and I can put you in contact with a great resource).

(4) If you do not have reporting software, you must ensure that you are accurately tracking the responses you are receiving. Remember this is not only important for reporting purposes but also for reconciliation purposes.

(5) As I mentioned above, these folks are going to call you repeatedly wanting to know when they will receive their check. They will also call wanting to know if you received their fax. I STRONGLY recommend you have a method for tracking faxes received and checks processed.

(6) KEEP COPIES and ORGANIZE THE RESPONSES! Whether you prefer hard copy or electronic, make sure you keep copies of all responses, faxes, letters, emails. This is proof in case you are ever placed under audit or there is ever any confusion regarding a payment.

Ricetta per il riso: INGREDIENTI 200 GR di riso ribe 1/2 tazza di aceto di riso (2 cucchiai di saké di buona qualità) 3 cucchiaini di zucchero semolato bianco 2 cucchiaini di sale fino Acqua di rubinetto qb PROCEDIMENTO Per prima cosa dobbiamo lavare il riso. Mettiamo quindi il riso in un contenitore non metallico e mettiamo l'acqua. Agitare il riso con le mani e scolarlo con un colino. Ripetere l'operazione più volte, fino a quando l'acqua resterà limpida anche dopo qualche minuto di immersione ed agitando il riso con le mani. Scolare con il colino e lasciarvelo per altri 10-15 minuti a scolare. Nel frattempo prepariamo il CONDIMENTO per il riso (Ne esistono cmq di già pronti in commercio). Mettiamo in una ciotolina o in un pentolino, lo zucchero e il sale, l'aceto di riso (e il saké). Mescoliamo la miscela e la passiamo nel micoonde o sul fuoco, a bassa temperatura, per far sciogliere lo zucchero depositato sul fondo. Quando lo zucchero si sarà sciolto del tutto, far raffreddare tenendo il contenitore coperto per non far evaporare il saké(se lo avete messo). Mettiamo il riso ben scolato in un pentolino, megli se anti-aderente, e copriamo con l'acqua fino a quando il livello dell'acqua non avrà superato quello del riso di 1 cm. , 1 cm. e mezzo. Poniamo sul fuoco a fiamma media fino a quando bolle. A questo punto, copriamo con il coperchio e passiamolo su una fiamma molto bassa, in ...

How to Train a Dog to Behave

As any dog owner would know, safety is always a priority when it comes to our pets. Dogs have these natural tendencies to focus their attention on moving objects. Objects that catch their attention such as cars or even other dogs. While most of us consider this a normal thing, sometimes it could be dangerous, especially when the dog is in an unprotected environment, like in the streets. You may want to train your dog to behave to avoid any accidents.

Now training can be difficult for some breeds. Usually smaller dogs are easier to train than big dogs and those who have been used for hunting are more difficult than those who have been used to living in homes. Training is best when your dog is still a puppy, open to your every command. You would want to ensure they take in your training so that they don't go run off and chase cars or even people and this would get you in trouble.

Until you have trained your dog very well, is it not advisable to take him off the leash yet. This can create danger both for you and the dog. Start your training in a quiet and relax place. One where you can have your dogs attention and focus all to yourself. Any distractions present should be removed. Repeat a command until your dogs gets it and move on to another command, all the while the leash is in place. Again, this is for safety reasons.

You will now want to stand with the dog at the end of a hallway or room. Take a ball and hold it in front of the dog without allowing him to look at it. After this, take the ball and roll it towards the opposite end of the room or hallway. Use the word "off" to tell your dog not to chase the ball. If your dog gets up and tries to chase the ball, gently pull back with the leash and say "off" again.

Repeat this step until the dog doesn't chase the ball when you roll it. When this is performed correctly, reward your dog with a treat.Repeat this technique in different rooms of the house. As your dog continues to improve, take him off the leash, but keep him indoors. Once you are confident that eh can behave well indoors as well as outdoors, then you can repeat the whole training outside.

GM and Chrysler Bankruptcy Provision Could Wreak Havoc on Tort Cases

California car accident lawyers have joined consumer groups, injured parties and other law firms around the country in opposing a provision in the General Motors and Chrysler bankruptcy plans that would free the automakers from liability for vehicle defects.

GM and Chrysler will enjoy immunity for any cars they manufactured up to the date of the bankruptcy filing. If anyone is ever injured or killed in a GM or Chrysler car that has a defect, no matter how far out into the future, those people cannot sue. This represents a very large tort reform.

The new provision is being opposed by eight state attorneys general, including those from Connecticut, Kentucky, Maryland, Minnesota, Missouri, Nebraska, North Dakota and Vermont. All have filed an objection in U.S. Bankruptcy Court in the Southern District of New York, arguing that GM's plan to shed these auto defect liabilities would bar car accident victims from crucial legal rights. The new proposal could also undercut double or triple damages--provisions that put real teeth into the lemon laws enacted by some states.

California car crash lawyers feel this provision impacts car consumers across the country. Individuals who have a pending auto product liability lawsuit, or anyone involved in a car accident that results in an auto product liability lawsuit, will not be able to recover for damages. Freeing an automaker from current and future tort liabilities has some very serious repercussions. Granted, they've made sure warranties are honored but that's where it ends. The government is basically saying that if you roll your SUV and the poorly designed roof caves in, killing or permanently injuring you, you can't go after the automaker. If your tire falls off, GM will honor that repair, but heaven forbid your tire falls off and you lose control of your vehicle, you get in a car accident and some other party is seriously injured or killed. YOU are liable, but NOT GM.

If the zero-tort liability provision is allowed, alternative backup measures should be adopted to protect consumers. If GM is immunized from liability for injury defect claims, then at least they should be required to get insurance, or have the government set aside part of their rescue package to cover these claims.

A national public awareness campaign regarding the provision's fallout has prompted a huge outcry among consumer groups nationwide. They urge consumers to voice their outrage in essentially immunizing GM and Chrysler from current and future auto defects liability. To stop this provision, write your congressperson and/or senator and let them know that bailing out an automaker is one thing, but excusing them from tort liability will have disastrous consequences.

Consumers also need to know that even past tort cases will be locked up in bankruptcy court, so after all the creditors are paid, and if there's any money left over, they'll get pennies on the dollar if they litigate their case in bankruptcy court.

California car collision lawyers are acting as consumer advocates when business or government agencies fail to act in cases where the public feels that a product is defective and might have caused them financial loss or even injury. However, GM's Federal bankruptcy court case greatly complicates any existing consumer law case.

7 Essential Nutrients

There are 7 essential nutrients that sustain human life. Here is a list of those 7 nutrients and what roll they play in your body, and in your life. Here is how or where you can get these 7 essential nutrients.

1) Water - is the body most basic need. With out water you would die in just a few days. It is important not to ignore your thirst. You should never try to reduce your fluid intake, you should actually try to drink the recommended 8 glasses of 8 ounces of water everyday. It is even more important if you are trying to lose weight. Plus by drinking that much water, it is very good for your skin, and can make you look younger.

2) Carbohydrates - provides fuel to meet energy needs. Complex carbohydrates, or starches, are found in many plant foods such as grains, potato's and rice. Carbohydrates should be 55 to 60 percent of your diet.

3) Protein - made up of amino acids, is essential for the growth and maintenance of body tissue, blood cells, hormones and enzymes. The best source of protein is meat, poultry, fish, milk products, and eggs. Vegetables, grains, fruits, legumes, seeds and nuts contain lesser amounts. Ten to 15 percent of your daily calorie intake should be from protein.

4) Fiber - is indigestible carbohydrate and is very important for general health. There are two types insoluble and soluble. Insoluble fiber acids in the digestive process: it can help prevent hemorrhoids and may also protect against cancer of the lower bowl. Sources include brown rice, brain, whole grain cereals and broccoli. Soluble fiber is thought to help reduce cholesterol and thus reduce the risk of heart and arterial disease It is found in oats, peas, beans, root vegetables, and citrus fruits. Recommended intake of fiber is 20g to 35g per day from different sources.

5) Fat - is essential as an energy store, to insulate the body against rapid heat loss, help produce hormones, cushion vital organs suck as the liver and kidneys, and aid in the absorption of certain vitamins. Fat should represent no more than 30 percent of the diet, but many people eat more. There are two main types of fat: saturated (predominant fat in vegetable oils). Fried and sugary foods that are high in saturated fat should be avoided, as they offer little nutritional value. On the other hand, unsaturated fats, especially the monounsaturated fat in olive oil, may help protect against heart disease.

6) Vitamins - are organic compounds, essential for body growth, function, maintenance and repair. They are categorized into two groups, water soluble and fat soluble. Water soluble vitamins including the B complex group and vitamins C, need to be replenished daily because they are not stored in the bodies tissue. Fat soluble vitamins, including A, D, E, and K, are stored by the body for long-periods of time, and so excessive intake may be harmful, a balanced diet that includes plenty of fresh fruit and vegetables and cereals should provide all the vitamins that the body needs.

7) Minerals - are essential inorganic compounds that aid energy production and body maintenance as well as assisting in the control of body reactions and reflexes. There are three groups; macro minerals, electrolytes (a subgroup of macromineral), and micro, or trace, elements. The macromineral, calcium magnesium, and required n larger amounts. The body needs trace minerals - chromium cooper, fluoride, iodine, iron magnesium and, molybdenum, selenium, sulfur, and zinc - in minuscule amounts. A diet that includes a wide range of animals and plant goods should provide all the minerals essential for health.

An essential nutrient is a nutrient required for normal body functioning that cannot be synthesized by the body and thus must be obtained from a dietary source. Some categories of essential nutrients include vitamins, dietary minerals, essential fatty acids, and essential amino acids.

Preparing Income Taxes - I'm Married, Should I File Jointly Or Separately?

The most advantageous way for married people to file their income taxes is married filing jointly (MFJ). There are, however, circumstances involving state taxes or large medical expenses, where a married filing separately (MFS) tax status has a financial advantage. If you are legally married as of December 31 of the tax year, the Internal Revenue Service would prefer you file jointly to simplify reporting and compliance issues. There are, thus, more disadvantages to MFS than advantages. The best way to determine whether or not to file as one or the other is to actually calculate your tax return using the two different filing statuses and compare the final balances owed (or refunds due). If you are married and are contemplating filing separately, seek professional advice before you prepare your income tax returns.

Consider the few advantages a legally married couple might have filing their income taxes separately. If a spouse has lived away from a "main home" for more than six months, the spouse in the home with a dependent can alternatively file Head of Household. Another consideration is that special debts that could trigger an income tax refund offset, such as child support or outstanding student loans, will only affect the return of the spouse who incurred the debt. Yet another special situation could arise with medical and dental expenses that are deductible only if they exceed a 7.5% threshold of the tax payer's adjusted gross income (AGI). Separation of incomes may provide an advantage to a spouse with large medical expenses and a lower AGI.

Since incomes are reported separately, one spouse does not have to assume full responsibility for the liability of the other. Remember though, that community property states will typically consider all property and income, not specifically identified as separate, to be "community"-owned. A spouse filing separately reports all income including their portion of the community-property income that arises from their marriage. Furthermore, any unearned income arising from community-owned property, such as interest income, is similarly divided between the two spouses. The community property states are Arizona, California, Idaho, Louisiana, Nevada, New Mexico, Texas, Washington, and Wisconsin. These states may also differ in their treatment of spousal liability. For example, California currently provides for "innocent spousal relief" but not relief for an "injured" spouse in tax liability issues. Remember too, that dependents can only be claimed once; just because you might be filing separately doesn't mean you can both claim the same child or split a dependent in half!

There are distinct disadvantages to filing separately. If you are married but file separately, you cannot take tax credits associated with adoption, education, child and dependent care nor earned income. You and your spouse must choose the same deduction method; whether itemized or standard. If you file separately but actually live together there are additional restrictions; you cannot claim passive loss from rental property, roll over certain retirement accounts, claim tax credits for the elderly or disabled, or calculate taxable social security at a lower, more advantageous rate. Calculate your taxes and compare the bottom lines; it's a question of money!

Do You Know the Pepper Spray Laws in Your State?

The laws may vary from state to state and most laws will deal with the amount of OC concentration the pepper spray is allowed to contain. OC stands for oleoresin capsicum and is the active ingredient that causes the burning sensation in pepper sprays. This OC component is found in cayenne and other hot chili peppers.

The amount of heat from pepper spray is measured by a Scoville heat unit or SHU for short. The higher the SHU, the more intense the burning sensation when it comes into contact with skin. The following states have outlined restrictions when it comes purchasing pepper sprays:  



New York: You can legally sell and ship animal repellants via the Internet but you cannot sell pepper spray for use on humans through the Internet. Pepper spray for personal protection can only be sold in pharmacies and from licensed dealers locally.

Michigan: The pepper spray must be less than 35 grams of the product and must be 2% or less of OC concentration. UV dyes are not allowed to be added to the pepper spray.

Massachusetts: Pepper spray can only be purchased at a local firearms dealer and cannot be purchased online.

Wisconsin: Pepper spray must be no stronger than 10% and contain pepper spray only. Safety features are required on all containers of pepper spray. The weight allowance is 15-60 grams.

California: This state does have a few laws regarding pepper sprays. It is legal to carry pepper spray for personal protection without having to get any special permit. But the container size must be equal to or less than 2.5 ounces of active product.

Washington D.C: You must register your pepper spray possession with the local law enforcement. 

The overall gist is that pepper spray is legal in all 50 states to be used as a defense weapon, but various states will have restrictions on shipping the pepper spray. Certain states will also regulate the concentration of pepper spray that you are allowed to use.So if you plan on carrying pepper spray as a way to defend yourself, make sure that you check with your local and state laws to prevent any problems for yourself. Pepper spray is a very effective way to stay safe but you must use in within compliance of the law.  

Pepper spray laws vary from state to state and they may even vary from city to city. Check with your local law enforcement before you start carrying pepper spray. But keep in mind that there is one place where you are not allowed to carry pepper spray. It is considered a felony to carry pepper spray on an airplane. So to avoid major problems for yourself, leave your pepper spray behind or in your luggage when flying.

Is Your Practice Medicare RAC Ready? - The Answer Lies in Your Documentation

The three year Medicare RAC demonstration that was conducted in California, Florida and New York demonstrated that one of the biggest areas where improper payments were identified was due to improper documentation by the physician.

As a practice administrator you may wondering how to ensure physician documentation leads to proper coding in the billing cycle. You may also be wondering how to go about improving the documentation of the physicians that work in your practice.   Proper training and education is critical to ensure that physician documentation is compliant and that it leads to accurate coding and billing.

As the Medicare Recovery Audit Contractors (RACs) roll out nationwide, it's now more important than ever that your practices administrative and physician staff work together to assess documentation risk areas that may be a potential audit risk to your organization. That way once these areas are identified, you can implement proper training and education for your physicians so that any documentation weaknesses will improve and your audit risk will be reduced.

During the demonstration period, approximately one third of improper payments identified by RAC auditors were cited as improper due to the fact they did not meet Medicare's medical necessity criteria for a particular service. Another significant amount of claims were identified as improper was due to the fact there was not enough documentation on requested medical records or information could not be gathered in time to respond to the RACs request. During the demonstration, through March 2008 improper payments totaling more than $391 million were recouped due to medical necessity criteria not being met, with another $74 million being recouped for insufficient documentation.

Here are a few steps your organization can perform to ensure that you will be RAC ready.

Identify Any Risk Areas

The first step is to assess your practice's documentation to identify any areas of risk. By examining past medical records, your practice can identify any areas of risk and the things your physicians may need additional training and education on. This review can be conducted internally if you feel that you have qualified staff that can conduct an independent review of your physician's documentation. 

If you don't feel competent about your internal staff performing the review, it is definitely worth considering hiring a qualified third party audit firm to come in and do a base line audit of all of your physician's documentation to identify any compliance issues.

The key whether you do this internally or utilize a third party is to make sure and involve both your clinical staff and administrative staff. Everyone needs to be informed of any defined goals, progress and issues identified so that everyone will buy into doing whatever it takes to correct the identified issues and bring your organization compliant. 

Provide Education and Training

If issues are identified, your physicians must be open to receiving training and additional education so that they can learn how to properly document patient encounters. This will greatly reduce your organizations audit risk in the future.

Make sure and also include your administrative and billing staff in the education process. Make sure and use real-world examples from your practice in you training as this is vital to ensuring your organization's documentation is thorough enough for clinical and billing needs. 

Training and education should be provided by certified professionals that have the coding and documentation knowledge relating to your specialty.

Education and training should not be a onetime thing but an on-going practice that is implemented into your organization's goals and objectives. The rules and regulations of compliance are constantly changing so it's critical that your organization continued to obtain proper education to ensure that your organization is current with compliance requirements.

Engaging both your physicians and staff in the process of RAC preparation is critical because it ensures that your organization will be as prepared as possible should the RACs select your organization for an audit.

Phthalates - Are They Dangerous?

Phthalates (pronounced thowl-ates) have been in the news a lot. We hear about the danger of phthalates in children's toys, about concerns that phthalates are used in cosmetics and the danger of PVC food and beverage containers.

So what are phthalates and are they dangerous?

Phthalates are a family of chemical compounds that are used to stabilize fragrances and increase the flexibility of plastics. They have been used in plastics since the 1930's and it's only recently that concerns have been raised. Phthalates are under attack by many environmental organizations who claim that there is strong evidence that these chemicals cause reproductive defects and early-onset of puberty in children. In October 2007 California Governor Arnold Schwarzenegger signed a bill banning certain phthalates from some toys and childcare articles.

In 2005 the European Parliament imposed a permanent ban on six chemicals used in plastic toys and childcare articles. These phthalate chemicals are used to soften the plastics. Young children can ingest these chemicals when they suck or chew on the soft plastic items.

A study released in February 2008 and that appeared in the journal Pediatrics states that these chemicals can potentially affect health. On the other hand, the U.S, Food and Drug Administration states that they have found no compelling evidence that phthalates pose a safety risk.

If you wish to error on the side of caution, how do you avoid phthalates? In terms of food and beverage containers and children's toys you should avoid any soft PVC. You can identify PVC on containers by examining the recycling triangle that appears on the bottom of most containers. PVC has a number 3 in the triangle.

Concerned parents can look for baby products such as shampoo that are labeled 'phthalate-free' and for products that do not include common phthalates such as DEP or DEHP. To avoid phthalates in cosmetics, avoid products that contain synthetic fragrance.

Until more research is done the situation with phthalates remains a confusing issue.

Athearn HO Trains

Irv Athearn, the founder of the Athearn Company, began his passion of collecting and assembling model trains in the year 1938. His work started at his mother's house, filling in an elaborate O-scale layout, changing it every now and then. This collection proved to be worth about $10000, and the response to his advertisement made him think about it as a business and profession.

Thus, the selling of trains started from his mother's house and by 1946, he became a full-time railroad retailer. The Loan Mod Industry is Dead?

As the as the financial train wreck from the housing crash keeps rumbling down the track across California, state lawmakers sent several bills that crack down on mortgage fraud to Gov. Arnold
Schwarzenegger's desk which effectively kill the loan modification industry.

Recently California legislature jointly passed bills to ban loan modification companies from asking for upfront fees and make mortgage brokers put their customers' financial needs ahead of their own
commissions. The Bills also propose to limit the size of pre-payment penalties and would add California to the list of states that allow prosecutors to file specific felony charges for those accused of mortgage fraud.

One of the Bills most sweeping mortgage reform bills this year, Assembly Bill 260, bans so-called subprime "negative amortization" loans where the principal balance grows even as the borrower makes payments. It also prevents mortgage brokers from collecting upfront fees prior to funding a loan for originating subprime loans and those with pre-payment penalties. The bill also limits the size of pre-payment penalties for
borrowers who pay off their loans early.

Lastly, it requires that mortgage brokers have a higher degree of duty to borrowers - that is, they must place the "economic interest of the borrower ahead of the broker's own economic interest" when making loans. Skilled Brokers already do this, of course. And that provision is especially opposed by the California
Association of Mortgage Brokers. Fred Arnold, a Santa Clarita-area broker and the group's past president, said the bill's definition of fiduciary duty is vague and an invitation to "frivolous lawsuits."

These bills were signed into law as California continues to ponder what to do in the wake of more than 410,000 foreclosures since the start of 2007, the aftermath of predatory lending practices and greedy brokers. It's also a time of high unemployment in the state and a devastated real estate and lending economy.

During the housing boom, mortgage brokers could earn fees of $20,000 or more for making risky subprime adjustable-rate loans, often to unsuspecting A contrary view would be the borrowers knew what they were
doing and decided to roll the dice in a surging market. many unqualified buyers got into homes they knew they could not afford but decided to engage in speculation in hopes that the anticipated record appreciation
in value would continue.

Among groups backing changes in mortgage practices is the California District Attorneys Association, which is pushing for new felony penalties for mortgage fraud. A bill now before the governor, Senate Bill 239, would create a specific category of felony mortgage fraud, which the DA's group hails as chief causes
California real estate market and the related crises in the financial sectors." Sacramento is ranked seventh among U.S. metropolitan areas in reporting mortgage fraud complaints to the FBI.

These bills were signed into law on October 30, 2009. While there is an interest in curbing abusive lending practices, there does not appear to be any discussion of the borrowers responsibility to become educated and knowledgeable about their own finances. There was also no discussion of effects of Governmental pressure to promote those programs, such as the Community Reinvestment Act. In fact, anyone who has read Thomas Sowell's book "The Housing Boom and Bust" can understand how government deregulation of the banks and over-regulating requiring funds to make "affordable housing" available, actually created the bust. Further, there should be some discussion of the effect of banning up front fees which will tend to chill assistance to borrowers trying to run the gauntlet of lenders ad hoc loan mod programs. Instead of banning upfront fees, the DRE might consider expanding those programs to put out of work real estate professionals back to work and providing a positive stimulus to the economy. Not many load mod people are going to be able, or willing to work to help borrowers unless they can charge something up front. Anyone dealing in the load mod arena has found that the process can be extremely tedious and can last from 3 to 6 months or more for approval. Any loan mod processor would be hard pressed to fund those efforts for that length of time.

While much of the commentary seems to focus on finding fault with the lending industry, it leads one to believe that all borrowers in trouble were just unwitting victims. This simply is not the case. There were two parties to the transaction, a willing buyer and a willing lender. It's time that people woke up and realized that it worked on both sides of the deal. Personal gain and profit were the motivators for both parties, not in long term thinking about cost or value.

Consumer Credit Card Debt Relief Scams! Are They Real?

I have been in the credit card debt relief industry for just about 10 years now and have been in the financial industry for over 20 years. The point of this article is to give people a heads up on debt relief companies also known as debt settlement or debt negotiation companies. I will give you the pro's and con's of this process and what to watch out for when interviewing a company to help you get out of debt. Before I go on I want to let you know that this will be a rather long article and by the end of it my goal is to have you understand how the debt negotiation/settlement process works in case you don't already know and I would like you to understand the tactics of companies out there that do not truly have your best interest at heart.

First I would like to state that the process of debt negotiation as your means of consumer debt relief is not for everyone, some people are better suited for bankruptcy and others do not have the correct mindset to go through this process.

I would like you to first understand what debt negotiation is and how it works. The goal of a debt negotiator is to obtain a debt settlement for you on the current debt amount you owe your creditor. So for example you may owe one particular creditor $10,000 so the goal of the negotiator would be to have you end up paying back say $6,000. The two main benefits of going through this process are to save money on what you currently owe your creditors and to save time. By just paying the minimum payment with even a modest interest rate you will be looking at 30 or more years to become debt free, with a sound debt negotiation program you will be out of debt within 2-3 years or sooner depending on your current financial situation.

Now you must understand these are great benefits but as with anything in life there are drawbacks, nothing is perfect and this consumer debt relief procedure is no different. For starters your creditors will not be willing to negotiate a debt settlement at all if you are current with your monthly minimum payments. They would prefer you to stay on their credit treadmill for the next thirty years and pay them back over four times the balance in interest alone. So you must fall behind on your payments to put the creditors into a position where they will be willing to settle. So obviously for some people the beginning of this process will have a negative effect on their credit score. For those who are already falling behind then the negative effect will be no different than it already is. Unfortunately for some people this will be the deterring factor that keeps them from going into debt settlement making them a slave to their creditors for the next thirty years. The good news is that this negative effect does not last forever, in fact once the settlements start coming through your credit score will begin to rebound and go back up. The reason being over 30% of your credit score according to MyFICO is based on how much debt you owe. But if you are stuck in a bad debt situation even if you are current with your payments your score is probably not all that good in the first place, and besides when stuck deep in debt your focus should be on how to get out of debt as quickly as possible, not on your ability to accrue future debt.

Now by falling behind on your debts you must understand that these creditors are just not going to roll over and play dead, they will be calling to try and collect the debt. For some this is not a problem at all, for others it is, that is why I stated above this process is not for everyone and the consumer must be in the correct mind set. From my years of helping people there is no rhyme or reason to how many calls you will receive some clients of mine barely get calls while others get them almost everyday. Something to keep in mind too is that no company has the power to legally stop the calls, so any company that tells you they can is flat out lying.

As you can see like I said earlier there are pro's and con's, but if you can accept the con's you will be quickly on the road to financial freedom and will save a lot of money in the process. Now to get to the meat of the matter and why I named this article "consumer credit card debt relief scams".

We here in America over the past couple of years have been experiencing a very negative downturn in our economy. Thus putting many consumers in a compromising position financially, leaving boat loads of people stuck in credit card debt. So naturally this opened up a much larger market for debt negotiation. Many fly by night companies have been popping up all over the country, many of which are ex mortgage brokers who sold people bad loans and helped them get into this sticky position in the first place. Now I use the word scam which can take on a few meanings, while yes there are some companies out there that are flat out scams and have no intent on doing any work for you at all, most of the times that is not the case. Instead many companies simply do not give people all the facts on how debt negotiation works nor do they truly put them on a plan for success, which I will explain in a minute.

One common issue that most consumers have with debt settlement companies is they do not fully tell them about how the process works, instead they sugar coat things and just preach about the great benefits. I have spoken to countless amounts of people who have signed up with companies and were under the impression that they were going to stay current with their creditors and will never receive any calls. So needless to say this became a huge problem once they began.

Another major problem a lot of these companies have is deceiving people into the kind of savings they will be getting on their debts. Some companies will say they will save you 70% of what you owe. Now while they may get settlements that low what their opting not to tell you is how much you will be saving after you have A) paid them their fees, and B) paid back the creditors. Honest companies will tell you what your true savings will be. If you will save somewhere between 40-50% of what you owe including their fees and paying the creditors than that is pretty darn good. Plus many of these companies will try and guarantee a certain amount of savings, if you hear this run for the hills. NO one in this industry can guarantee a certain amount that is why it is called DEBT NEGOTIATION! They are negotiating to get a settlement for as low as they can get.

Then there are the companies who will let you pay whatever you can to get on their program. These are the worst because they do not truly have your interest at heart and know they are setting you up to fail and not succeed. You must understand to achieve the type of savings I stated above this process should take no more than three years, preferably two or less. And the bottom line is some people simply cannot get it done in that time frame and should realistically be looking into bankruptcy. What these unscrupulous consumer debt relief companies will do is put you on a program for 4 or more years and basically accepts whatever payment you can afford. Knowing full well you are not going to be saving much of anything and will more than likely fail off the program, all they care about is getting the fees and that is it. An honest company will diligently review your budget with you and make sure this is something that you can manage, as well as fully explain to you both the benefits and drawbacks of doing this. And let you make the conscience decision as to whether this is the best consumer debt relief method for your situation.

Another very good way to evaluate a company is to make sure they are registered with the BBB (Better Business Bureau) and that they are in good standings with very few complaints. And if there are complaints make sure they were resolved to the clients liking.
