Do You Know the Pepper Spray Laws in Your State?

The laws may vary from state to state and most laws will deal with the amount of OC concentration the pepper spray is allowed to contain. OC stands for oleoresin capsicum and is the active ingredient that causes the burning sensation in pepper sprays. This OC component is found in cayenne and other hot chili peppers.

The amount of heat from pepper spray is measured by a Scoville heat unit or SHU for short. The higher the SHU, the more intense the burning sensation when it comes into contact with skin. The following states have outlined restrictions when it comes purchasing pepper sprays:  



New York: You can legally sell and ship animal repellants via the Internet but you cannot sell pepper spray for use on humans through the Internet. Pepper spray for personal protection can only be sold in pharmacies and from licensed dealers locally.

Michigan: The pepper spray must be less than 35 grams of the product and must be 2% or less of OC concentration. UV dyes are not allowed to be added to the pepper spray.

Massachusetts: Pepper spray can only be purchased at a local firearms dealer and cannot be purchased online.

Wisconsin: Pepper spray must be no stronger than 10% and contain pepper spray only. Safety features are required on all containers of pepper spray. The weight allowance is 15-60 grams.

California: This state does have a few laws regarding pepper sprays. It is legal to carry pepper spray for personal protection without having to get any special permit. But the container size must be equal to or less than 2.5 ounces of active product.

Washington D.C: You must register your pepper spray possession with the local law enforcement. 

The overall gist is that pepper spray is legal in all 50 states to be used as a defense weapon, but various states will have restrictions on shipping the pepper spray. Certain states will also regulate the concentration of pepper spray that you are allowed to use.So if you plan on carrying pepper spray as a way to defend yourself, make sure that you check with your local and state laws to prevent any problems for yourself. Pepper spray is a very effective way to stay safe but you must use in within compliance of the law.  

Pepper spray laws vary from state to state and they may even vary from city to city. Check with your local law enforcement before you start carrying pepper spray. But keep in mind that there is one place where you are not allowed to carry pepper spray. It is considered a felony to carry pepper spray on an airplane. So to avoid major problems for yourself, leave your pepper spray behind or in your luggage when flying.
